【摘要】：南海地區(qū)的人工噪音來源廣、種類多,已經(jīng)對該地區(qū)的海洋生物產(chǎn)生了實(shí)際的危害后果。國際法上關(guān)于規(guī)制南海噪音的主要依據(jù)有《聯(lián)合國海洋法公約》、《生物多樣性公約》、風(fēng)險(xiǎn)預(yù)防原則以及不得損害國外環(huán)境原則。上述法律依據(jù)在具體規(guī)制南海的海洋噪音污染時(shí)存在法律義務(wù)不明確、可操作性差等諸多局限性。為了切實(shí)保護(hù)南海地區(qū)的海洋環(huán)境,中國與東盟國家應(yīng)該確立合作規(guī)制南海海洋噪音污染的法律目標(biāo)、設(shè)定合作規(guī)制南海海洋噪音污染的具體法律路徑、明確合作規(guī)制南海海洋噪音污染的具體內(nèi)容。中國不僅要積極完善本國國內(nèi)法關(guān)于防治海洋噪音污染的法律制度,而且還應(yīng)該積極利用正在與東盟國家磋商制定《南海行為準(zhǔn)則》的良好契機(jī),為早日通過南海地區(qū)第一份規(guī)制海洋噪音污染的法律文件而努力。
[Abstract]:The South China Sea area has a wide range of artificial noise sources and many kinds of noise. The main basis for regulating noise in the South China Sea in international law is the United Nations Convention on the Law of the Sea, the Convention on Biological Diversity, the principle of risk prevention and non-harm. Foreign environmental principles. The legal basis mentioned above is unclear when regulating marine noise pollution in the South China Sea. In order to effectively protect the marine environment in the South China Sea, China and ASEAN countries should establish a legal goal of cooperation in regulating marine noise pollution in the South China Sea. The specific legal path of cooperative regulation of marine noise pollution in the South China Sea should be established, and the specific contents of cooperative regulation of marine noise pollution in the South China Sea should be clarified. China should not only actively improve its domestic legal system on the prevention and control of marine noise pollution. In addition, we should actively take advantage of the opportunity of developing the Code of Conduct in the South China Sea in consultation with ASEAN countries, and work hard for the early adoption of the first legal document on the regulation of marine noise pollution in the South China Sea.
