【摘要】：全球公域中國家利益的界定與實(shí)現(xiàn)與一般的國家利益有所不同。能力成為國家在公域利益實(shí)現(xiàn)的主要因素,同時(shí),公域的國家行為必須受到一定規(guī)則的約束和管制,以免公地悲劇的發(fā)生。同樣,能力和國際規(guī)則、制度也是維護(hù)國家權(quán)益的主要因素。從公域限制國家能力向權(quán)利轉(zhuǎn)化的角度來說,公域的國家利益實(shí)現(xiàn)是受限的;與此不同,公域的國家權(quán)益維護(hù)朝著相反方向運(yùn)作,即國家權(quán)益應(yīng)在最大程度上得到保護(hù)。在假設(shè)南極為全球公域的前提下,中國作為一個(gè)南極事務(wù)重要參與者具有南極利益和權(quán)益,中國的南極利益包括政治利益、安全利益、科研利益、經(jīng)濟(jì)利益等;南極權(quán)益包括參與權(quán)、科研權(quán)、治理權(quán)、地理命名權(quán)、開發(fā)使用權(quán)等。
[Abstract]:The definition and realization of the national interests in the global public domain are different from those of the general national interests. Capacity has become the main factor for the realization of the national interests in the public domain, and at the same time. The acts of States in the Commons must be bound and regulated by certain rules in order to avoid the tragedy of the Commons. Similarly, capacity and international rules. The system is also the main factor to safeguard the national rights and interests. From the point of view of restricting the national capacity to the right, the realization of the public domain's national interests is limited. In contrast, the national rights and interests of the Commons operate in the opposite direction, that is, national rights and interests should be protected to the greatest extent, assuming that Antarctica is a global Commons. As an important participant in Antarctic affairs, China has Antarctic interests and interests. China's Antarctic interests include political interests, security interests, scientific research interests, economic interests and so on. Antarctic rights include participation right, scientific research right, governance right, geographical naming right, development right and so on.
