【摘要】：在市場(chǎng)經(jīng)濟(jì)條件下，行政執(zhí)法對(duì)規(guī)范政府行為、促進(jìn)地方經(jīng)濟(jì)又好又快地發(fā)展、完善政府的執(zhí)政能力都有著非常重要的意義�；谏蜿�(yáng)市的行政執(zhí)法在振興發(fā)展東北老工業(yè)基地的進(jìn)程中，對(duì)于東北區(qū)域乃至于全國(guó)都具有良好的示范作用和輻射價(jià)值，本文選取沈陽(yáng)市的行政執(zhí)法作為研究對(duì)象。深入了解沈陽(yáng)市行政執(zhí)法的現(xiàn)狀，分析沈陽(yáng)市行政執(zhí)法問(wèn)題的成因，有助于促進(jìn)行政執(zhí)法工作的公平公正，進(jìn)一步約束行政執(zhí)法工作中的權(quán)力濫用問(wèn)題，提升行政機(jī)構(gòu)執(zhí)法辦事的科學(xué)、民主和高效。本文通過(guò)分析研究沈陽(yáng)市行政執(zhí)法的問(wèn)題，利用比較成熟的史密斯模型理論框架找到城市綜合治理行政執(zhí)法的未來(lái)道路，保證行政執(zhí)法機(jī)關(guān)和執(zhí)法者始終牢記為民服務(wù)的理念，努力提升自我素質(zhì)，推動(dòng)行政執(zhí)法體制的規(guī)范完善。 本文共分為五個(gè)部分。第一部分是緒論，，主要介紹了選題的目的、意義、研究的背景和方法，指出了論文的創(chuàng)新點(diǎn)和不足之處，提出文章后續(xù)的研究框架；第二部分是本文的基本概念和理論闡述，界定了政策執(zhí)行和行政執(zhí)法的內(nèi)涵等主要概念，為后續(xù)的分析論述劃清范圍，保證研究的嚴(yán)謹(jǐn)性；第三部分是沈陽(yáng)市行政執(zhí)法的現(xiàn)狀與問(wèn)題，該部分根據(jù)史密斯模型對(duì)沈陽(yáng)市的行政執(zhí)法現(xiàn)狀進(jìn)行了分析，并從中挖掘出行政執(zhí)法政策定位不夠明晰、行政執(zhí)法呈現(xiàn)政出多門(mén)、執(zhí)法人員整體素質(zhì)偏低、政策執(zhí)行忽視民情民意和政策執(zhí)行監(jiān)督流于形式等問(wèn)題；第四部分是沈陽(yáng)市行政執(zhí)法現(xiàn)存問(wèn)題的成因分析，該部分從行政執(zhí)法的政策制定、執(zhí)行機(jī)關(guān)、目標(biāo)群體和政策環(huán)境四個(gè)角度來(lái)分析行政執(zhí)法現(xiàn)存問(wèn)題的影響因素；最后一部分是沈陽(yáng)市行政執(zhí)法現(xiàn)存問(wèn)題的對(duì)策研究，該部分基于史密斯模型理論，從沈陽(yáng)市行政執(zhí)法現(xiàn)存的問(wèn)題出發(fā)，提出了全面科學(xué)地制定行政執(zhí)法政策、積極推進(jìn)行政執(zhí)法隊(duì)伍的建設(shè)、行政執(zhí)法應(yīng)立足于以人為本和塑造行政執(zhí)法實(shí)施的良好環(huán)境等相應(yīng)的科學(xué)對(duì)策。
[Abstract]:Under the condition of market economy, administrative law enforcement plays an important role in standardizing the government's behavior, promoting the development of the local economy and perfecting the government's governing ability. In the process of revitalizing and developing the northeast old industrial base, the administrative law enforcement based on Shenyang has a good demonstration function and radiation value for the northeast region and even in the whole country. This paper chooses Shenyang's administrative law enforcement as the research object. A deep understanding of the present situation of administrative law enforcement in Shenyang and an analysis of the causes of administrative law enforcement problems in Shenyang will help to promote the fairness and fairness of administrative law enforcement work and further restrict the abuse of power in administrative law enforcement work. To improve the scientific, democratic and efficient administration of law enforcement. This paper analyzes and studies the problems of administrative law enforcement in Shenyang, uses the mature Smith model theory framework to find out the future road of urban comprehensive governance administrative law enforcement, and ensures that the administrative law enforcement organs and enforcers always keep in mind the idea of serving the people. Strive to improve self-quality and promote the perfection of administrative law enforcement system. This paper is divided into five parts. The first part is the introduction, which mainly introduces the purpose, significance, background and method of the research, points out the innovation and deficiency of the paper, and puts forward the framework of the following research. The second part is the basic concept and the theoretical elaboration of this article, has defined the policy execution and the administrative law enforcement connotation and so on the main concept, for the follow-up analysis elaboration delimits the scope, guarantees the research preciseness; The third part is the current situation and problems of Shenyang's administrative law enforcement. According to Smith's model, this part analyzes the present situation of Shenyang's administrative law enforcement, and excavates from it that the orientation of administrative law enforcement policy is not clear enough, and administrative law enforcement presents many sources of power and output. The overall quality of law enforcement personnel is on the low side, policy implementation ignores the public opinion and policy implementation supervision is a mere formality; The fourth part is the analysis of the causes of the existing problems of the administrative law enforcement in Shenyang. This part analyzes the influencing factors of the existing problems of the administrative law enforcement from the four angles of the policy formulation, the executive organ, the target group and the policy environment. The last part is the countermeasure research on the existing problems of Shenyang's administrative law enforcement. Based on Smith's model theory and from the existing problems of Shenyang's administrative law enforcement, this part puts forward a comprehensive and scientific formulation of administrative law enforcement policies. To actively promote the construction of administrative law enforcement team, administrative law enforcement should be based on people-oriented and create a good environment for the implementation of administrative law enforcement and other relevant scientific countermeasures.
