【摘要】： 村官職務(wù)犯罪及其防范機(jī)制的完善是我國當(dāng)前面臨的一個重大社會政治問題。當(dāng)前,我國村官職務(wù)犯罪從區(qū)域特征來看集中在城鄉(xiāng)結(jié)合部和封閉的欠發(fā)達(dá)地區(qū),從主體特征來看以一把手為主,大部分犯罪主體文化素質(zhì)低,法律意識淡薄,犯罪主體黨員多,呈現(xiàn)集體犯罪的局面。犯罪手法簡單粗糙。從犯罪動機(jī)看主要是升官和狹隘的“報恩"思想。犯罪性質(zhì)主要是經(jīng)濟(jì)犯罪和罪錯交叉。村官職務(wù)犯罪近年來在我國呈現(xiàn)數(shù)量大,大案、要案增多,土地交易成為高發(fā)領(lǐng)域,并伴隨暴力現(xiàn)象。村官職務(wù)犯罪造成干群關(guān)系緊張,嚴(yán)重破壞了農(nóng)村社會政治穩(wěn)定,影響黨和國家各項政策在農(nóng)村的落實,損害黨和政府的形象。 村官職務(wù)犯罪主要由主客觀兩個方面的原因造成,主觀原因主要包括教育機(jī)制不完善,村官個體素質(zhì)不高,民主法律意識淡薄、個體心理失衡等造成。客觀方面的原因主要包括經(jīng)濟(jì)、制度和用人機(jī)制等方面原因。近年來我國在防范村官職務(wù)犯罪上加強(qiáng)了村官審計,實現(xiàn)了“三大轉(zhuǎn)向”,提高了村官的待遇,但在監(jiān)督和審計還存在不足。 我們要從黨執(zhí)政興國的高度,充分認(rèn)識遏制“村官”職務(wù)犯罪的重要性和緊迫性,堅持標(biāo)本兼治,綜合治理的方針,加強(qiáng)和完善村官職務(wù)犯罪防范的教育機(jī)制、干部選拔任用機(jī)制、監(jiān)督機(jī)制和保障機(jī)制。
[Abstract]:The perfection of village official duty crime and its preventive mechanism is a major social and political problem facing our country at present. At present, the crime of village official duty in our country is concentrated in the combination of urban and rural areas and the closed underdeveloped areas in terms of the regional characteristics, and the main body features are the top one, most of which are of low cultural quality and weak legal consciousness. Crime main party member is many, present the situation of collective crime. The crime is simple and crude. From the perspective of criminal motive, it is mainly promotion and narrow thought of "retribution". The nature of crime is mainly the intersection of economic crime and crime error. In recent years, the number of village official crime in our country is large, big cases, important cases increase, land transaction has become a high incidence area, and accompanied by violence phenomenon. The crime of village officials' official duties causes tension between cadres and the masses, seriously undermines the social and political stability in rural areas, affects the implementation of various policies of the Party and the state in the countryside, and damages the image of the Party and the government. The crime of village official's duty is mainly caused by subjective and objective reasons. Subjective reasons mainly include imperfect education mechanism, low quality of village official, weak consciousness of democratic law, and individual psychological imbalance. The objective reasons include economy, system and employment mechanism. In recent years, our country has strengthened the audit of village officials in preventing the crime of village officials' duties, realized the "three big turns" and improved the treatment of village officials, but there are still some deficiencies in supervision and audit. We should fully understand the importance and urgency of curbing the crime of "village officials" posts from the height of the Party's ruling and rejuvenating the country, adhere to the principle of treating both the symptoms and the root causes, and comprehensively manage it, and strengthen and improve the educational mechanism for preventing village officials' job-related crimes. The mechanism of selecting and appointing cadres, the mechanism of supervision and the mechanism of guarantee.
