論網(wǎng)吧行業(yè)政府管制

【摘要】： 1995年左右,網(wǎng)吧開始在中國的大中城市興起,自網(wǎng)吧誕生之日起,就伴隨著未成人上網(wǎng)、黑網(wǎng)吧泛濫等諸多問題。作為一個(gè)備受爭議的問題行業(yè),國家有關(guān)主管部門對(duì)網(wǎng)吧行業(yè)加大了管理力度,并陸續(xù)出臺(tái)了《互聯(lián)網(wǎng)上網(wǎng)服務(wù)營業(yè)場所管理?xiàng)l例》等一系列法規(guī)和規(guī)章。作為一種重要的行政行為,政府管制的實(shí)質(zhì)是對(duì)市場規(guī)則的修正。政府應(yīng)該對(duì)市場進(jìn)行管制的理由主要有兩點(diǎn):一是由于外部性尤其外部“負(fù)效應(yīng)”的存在,需要政府進(jìn)行管制;二是因?yàn)槭袌鍪ъ`,即信息的不對(duì)稱和不完全導(dǎo)致的所謂“內(nèi)部性”。目前我國政府管制的效果還很不理想,“管制失靈”在各種受管制市場上普遍存在。 中國網(wǎng)吧業(yè)為我們分析政府管制提供了一個(gè)真實(shí)的藍(lán)本,本文通過對(duì)網(wǎng)吧行業(yè)政府管制的個(gè)案解讀,以發(fā)生在該領(lǐng)域的典型案例為例,從政府對(duì)網(wǎng)吧行業(yè)不管制到加強(qiáng)管制的三個(gè)階段:即前管制階段,管制深化階段和連鎖經(jīng)營階段著手,分析網(wǎng)吧行業(yè)政府管制的性質(zhì)、主體、對(duì)象、手段等結(jié)構(gòu)要素,從管制規(guī)則設(shè)立的不合理和管制手段的不規(guī)范兩個(gè)方面解析“管制失靈”所產(chǎn)生的原因,然后運(yùn)用行政法學(xué)及政府管制原理進(jìn)行微觀實(shí)證分析,論述良好管制的原則,在放松管制背景下,提出改善我國網(wǎng)吧行業(yè)政府管制體系的構(gòu)想。
[Abstract]:Around 1995, Internet cafes began to rise in large and medium-sized cities in China. Since the birth of Internet cafes, there have been many problems, such as the proliferation of Internet cafes and the proliferation of Internet cafes. As a controversial problem industry, the competent authorities of the state have strengthened the management of the Internet bar industry, and have successively issued a series of laws and regulations, such as the regulations on the Administration of Business places for Internet access Services, and so on. As an important administrative act, the essence of government regulation is the amendment of market rules. There are two main reasons why the government should regulate the market: first, because of the existence of externality, especially the external "negative effect", it is necessary for the government to regulate; Second, because of market failure, that is, asymmetric and incomplete information caused by the so-called "internality." At present, the effect of government regulation in our country is not ideal, "regulation failure" exists in all kinds of regulated markets. The Chinese Internet cafes industry provides us with a true blueprint for the analysis of government regulation. This paper takes the typical cases in this field as an example by interpreting the case of government regulation in the Internet bar industry. From the three stages that the government does not regulate the Internet bar industry to strengthen the regulation: the stage of pre-regulation, the stage of deepening the regulation and the stage of chain operation, this paper analyzes the nature, subject, object, means and other structural elements of the government regulation in the Internet bar industry. This paper analyzes the causes of "regulation failure" from the two aspects of unreasonable regulation rules and non-standard control means, and then analyzes the principles of good regulation by using the administrative law and the principle of government regulation. Under the background of deregulation, the paper puts forward the idea of improving the government regulation system of Internet cafes in China.
