我國恐怖活動犯罪研究

【摘要】：當前，我國的恐怖活動主要表現(xiàn)為分裂勢力和極端宗教勢力進行的以分裂國家為目的的恐怖活動，包括新疆、西藏等地的“東突”、“藏獨”分裂勢力、宗教極端勢力的活動，已經(jīng)影響到邊疆地區(qū)的穩(wěn)定與發(fā)展，危害到國家安全。研究國內(nèi)恐怖活動犯罪問題，對于開展反恐怖斗爭有著重要的現(xiàn)實意義。本文以“東突”恐怖勢力的活動為切入點，以此透視我國恐怖活動犯罪的特點，通過考察恐怖活動的演變，分析恐怖活動犯罪可能的發(fā)展態(tài)勢，并在剖析成因的基礎上，有針對性的提出反恐怖的對策建議。 本文除引言和結束語外，共分為四個部分，全文四萬余字。 第一部分為恐怖活動犯罪概述。文章首先闡釋了恐怖活動的含義，在分析國內(nèi)外現(xiàn)存觀點分歧的基礎上，對恐怖活動進行了界定，認為：恐怖活動是指個人、集團或國家為實現(xiàn)非法目的，對不特定多數(shù)人的生命、健康或財產(chǎn)使用暴力或其他破壞性手段，制造恐怖氣氛，危害公共安全的刑事犯罪行為。其次介紹了恐怖活動最主要的分類，即根據(jù)行為的動機和根源，將其分為：極端民族主義型、宗教極端主義型、邪教型、極右型、極左型、黑社會型。最后介紹了當前恐怖活動犯罪的概況，既包括周邊地區(qū)的情況，也包括國內(nèi)的情況，為全面認識恐怖活動犯罪奠定基礎。 第二部分主要論述了恐怖活動犯罪的特點和成因。從犯罪組織、犯罪目的、犯罪手段、犯罪行為、侵害目標和犯罪時間六個方面概括出此類犯罪的特點，認為恐怖活動犯罪具有以下特點：①具有一定的組織性；②成立的目的性；③犯罪手段的暴力性；④犯罪行為的多樣性；⑤侵害目標的雙重性；⑥犯罪時間的選擇性。隨后，，就國際背景、思想根源、經(jīng)濟根源等四個方面來剖析恐怖活動犯罪產(chǎn)生的原因，認為：由于西方資本主義國家“和平演變”戰(zhàn)略的滲透，境外分裂勢力的直接支持和滲透，國際恐怖勢力的支持，“雙泛”思潮及地區(qū)間經(jīng)濟、文化發(fā)展差異性的影響共同作用，導致恐怖活動產(chǎn)生并蔓延。 第三部分主要分析了恐怖活動犯罪的發(fā)展態(tài)勢。分為起源階段(1949年以前)、全面準備階段(1949—1989)、惡性膨脹階段(1990—2001)、戰(zhàn)略蟄伏階段(2001．9以后)四個階段來考察恐怖活動的由來和演變歷史，并在此基礎上，對恐怖活動犯罪的發(fā)展進行合理的前瞻性分析，闡釋了恐怖活動犯罪可能的發(fā)展態(tài)勢：①策略上加快推進“東突問題”國際化的步 伐;②組織上加快實現(xiàn)“五個統(tǒng)一”的步伐;③內(nèi)外聯(lián)合，對抗性升級， 向著武裝化方向發(fā)展;④犯罪形式上新的發(fā)展;⑤犯罪的隱蔽性和智能化 將更加突出。 第四部分著重闡釋了遏制恐怖活動犯罪的對策。在考察國外反恐怖措 施的基礎上，針對我國反恐怖措施的現(xiàn)狀，以預防和打擊并重為原則，提 出遏制恐怖活動犯罪的相關建議。分別從立法機制、協(xié)調(diào)機制、情報機制、 偵查機制、防范機制、輿論機制等九個方面進行了分析，提出以下建議: ①完善反恐立法，制定專門系統(tǒng)的反恐法;②完善反恐怖布湘建設;③強 化整體意識，加強各職能部門協(xié)作，完善反恐怖協(xié)調(diào)機制;④加強情寸食唁 息網(wǎng)絡建設，形成系統(tǒng)而嚴密的反恐怖情報信息網(wǎng)絡;⑤加大偵查工作力 度，進一步提高反恐怖的專案偵查水平;⑥加強基層基礎工作，建立和完 善防范和控制體系;⑦完善反洗錢措施，加大對金融渠道的監(jiān)控，以切斷 恐怖組織的經(jīng)濟來源;⑧加強反恐怖專業(yè)人員培訓和反恐技術的研制和開 發(fā)工作，提高反恐斗爭中的科技含量;⑨加強反恐怖宣傳和新聞控制。
