【摘要】: 商業(yè)賄賂是不正當(dāng)競(jìng)爭(zhēng)行為的一種,它嚴(yán)重破壞了我國(guó)的市場(chǎng)經(jīng)濟(jì)秩序,損害了消費(fèi)者的合法權(quán)益,也在一定程度上誘導(dǎo)了公職人員的受賄犯罪,已到了非治不可的程度。因此,必須切實(shí)采取有效措施,加強(qiáng)對(duì)商業(yè)賄賂行為的懲治力度。本文從商業(yè)賄賂的行為特征入手,分析了商業(yè)賄賂給國(guó)家和社會(huì)帶來的嚴(yán)重危害,特別是對(duì)我國(guó)公平競(jìng)爭(zhēng)秩序造成的巨大破壞,進(jìn)而通過深刻剖析商業(yè)賄賂行為產(chǎn)生的原因,,提出對(duì)它的預(yù)防和懲治辦法。 全文共分五個(gè)部分:第一部分為商業(yè)賄賂的特性研究,主要對(duì)商業(yè)賄賂行為做出科學(xué)界定,對(duì)其行為主體、賄賂內(nèi)容、主觀心態(tài)及隱蔽性和違法性等五個(gè)特征進(jìn)行分析,還將商業(yè)賄賂行為與回扣、折扣、俑金、賄賂罪四種相關(guān)行為做了認(rèn)真地比較和嚴(yán)格地區(qū)別。第二部分是商業(yè)賄賂行為的分類,對(duì)其兩種類型一商業(yè)行賄和商業(yè)受賄進(jìn)行研究。第三部分重點(diǎn)分析了商業(yè)賄賂的危害。第四部分是對(duì)商業(yè)賄賂行為的產(chǎn)生原因的剖析,包括社會(huì)根源和個(gè)人原因。前者主要有新舊體制轉(zhuǎn)換過程中的矛盾;經(jīng)濟(jì)領(lǐng)域中的供需矛盾和商品市場(chǎng)經(jīng)濟(jì)的消極作用;思想領(lǐng)域中的錯(cuò)誤思潮的影響;執(zhí)法不嚴(yán)、打擊不力等。后者主要有主體法紀(jì)觀不健全;經(jīng)營(yíng)實(shí)力不厚,競(jìng)爭(zhēng)力較。痪哂胁缓侠、超常的需要等。第五部分為商業(yè)賄賂行為的防治,這一部分是全文的落腳點(diǎn)和歸宿,也因此是重點(diǎn)著墨之處。在預(yù)防方面,筆者提出五種措施,即深化改革,營(yíng)造公平競(jìng)爭(zhēng)的市場(chǎng)環(huán)境;改善和強(qiáng)化政府行政管理;完善市場(chǎng)規(guī)則系統(tǒng);完善市場(chǎng)監(jiān)督機(jī)制,加強(qiáng)對(duì)企業(yè)特別是企業(yè)決策者的法律監(jiān)督;提高企業(yè)和企業(yè)成員的綜合素質(zhì)。在懲治方面,則采取罰款、沒收,責(zé)令停產(chǎn)停業(yè)、吊銷許可證或執(zhí)照;追究刑事責(zé)任等多種措施。
[Abstract]:Commercial bribery is a kind of unfair competition behavior, which seriously damages the order of market economy, damages the legitimate rights and interests of consumers, and induces the bribery crime of public officials to a certain extent. Therefore, we must take effective measures to strengthen the punishment of commercial bribery. Starting with the characteristics of commercial bribery, this paper analyzes the serious harm that commercial bribery brings to the country and society, especially the great damage to the fair competition order of our country, and then analyzes the causes of commercial bribery deeply. Put forward its prevention and punishment. The thesis is divided into five parts: the first part is the research on the characteristics of commercial bribery, which mainly defines the commercial bribery behavior scientifically, analyzes its main body, bribery content, subjective mentality, concealment and illegality. Commercial bribery and kickbacks, discounts, terracotta warriors, bribery crimes are carefully compared and strictly distinguished. The second part is the classification of commercial bribery, the two types of commercial bribery and commercial bribery are studied. The third part analyzes the harm of commercial bribery. The fourth part is the analysis of the causes of commercial bribery, including social and personal causes. The former mainly includes the contradictions in the process of the transformation of the new and the old system, the contradiction between supply and demand in the economic field and the negative role of the commodity market economy, the influence of the wrong ideological trend in the ideological field, the lax enforcement of the law, the weak crackdown, and so on. The latter is mainly subject view of law and discipline is not perfect, management strength is not thick, competitiveness is small, have unreasonable, extraordinary need and so on. The fifth part is the prevention and cure of commercial bribery. In the aspect of prevention, the author puts forward five kinds of measures, that is, deepening the reform, creating a market environment of fair competition, improving and strengthening the government administration, perfecting the system of market rules, perfecting the mechanism of market supervision, We should strengthen the legal supervision over enterprises, especially the decision makers, and improve the comprehensive quality of enterprises and their members. In the aspect of punishment, we should take many measures, such as fine, confiscation, suspension of production and business, revocation of license or license, investigation of criminal responsibility and other measures.
