【摘要】：商業(yè)賄賂犯罪是指單位或者個(gè)人為了購買或者銷售商品,給予對(duì)方單位或者個(gè)人以財(cái)物的行為。商業(yè)賄賂犯罪的原因是社會(huì)因素與個(gè)人因素作為系統(tǒng)的結(jié)合作用。反商業(yè)賄賂犯罪,必須注意科學(xué)的刑事政策,建議在刑法中增設(shè)商業(yè)受賄罪和商業(yè)行賄罪,同時(shí)明確偵辦權(quán)限,以構(gòu)建科學(xué)的商業(yè)賄賂犯罪預(yù)防與治理機(jī)制。
[Abstract]:Commercial bribery crime refers to the act of giving a unit or individual to the other unit or individual for the purchase or sale of goods. The reason for the crime of commercial bribery is the combination of social factors and individual factors. The criminal policy of anti commercial bribery must be paid attention to scientific criminal policy, and it is suggested that commercial bribery should be added to the criminal law. Crime and commercial bribery, at the same time clear investigation rights, in order to build a scientific commercial bribery crime prevention and governance mechanism.
