【摘要】：拐賣(mài)人口犯罪是一種嚴(yán)重侵犯人身權(quán)利的犯罪,也是當(dāng)前一個(gè)全球性的嚴(yán)重 問(wèn)題。當(dāng)今世界各國(guó)無(wú)不將拐賣(mài)人口犯罪作為嚴(yán)重侵犯人身權(quán)和人格尊嚴(yán)的犯罪, 并在刑法中加以規(guī)定。中國(guó)政府一貫重視對(duì)拐賣(mài)人口犯罪的懲治和打擊,到 20 世 紀(jì) 60 年代,拐賣(mài)人口現(xiàn)象在中國(guó)大陸已經(jīng)基本絕跡,但隨著社會(huì)和經(jīng)濟(jì)的發(fā)展, 拐賣(mài)人口犯罪又死灰復(fù)燃,自 20 世紀(jì) 70 年代開(kāi)始,我國(guó)的拐賣(mài)人口犯罪呈上升 趨勢(shì)。特別是 20 世紀(jì) 90 年代以來(lái),由于各地經(jīng)濟(jì)發(fā)展的不平衡以及人們社會(huì)生 活貧富之間差距的加大,拐賣(mài)人口犯罪在數(shù)量上有增無(wú)減,并呈現(xiàn)出許多新型的 特點(diǎn)。 本文除導(dǎo)言和后記外,共分四部分,約 37,000 字,其中腳注 2400 余字。 第一部分是對(duì)拐賣(mài)人口犯罪的綜合論述。文章闡述了拐賣(mài)人口犯罪的定義和 我國(guó)關(guān)于拐賣(mài)人口罪的法律規(guī)定,考察了世界各國(guó)和地區(qū)拐賣(mài)人口犯罪的歷史、 現(xiàn)狀及特點(diǎn),并重點(diǎn)對(duì)當(dāng)代中國(guó)拐賣(mài)人口的現(xiàn)狀及特點(diǎn)進(jìn)行了系統(tǒng)論述。 第二部分描述了當(dāng)代中國(guó)拐賣(mài)人口犯罪的基本特征。文章認(rèn)為,拐賣(mài)人口犯 罪的行為特征主要體現(xiàn)為動(dòng)機(jī)的貪利性、手段的多樣性、行為的持續(xù)性、地域的 特定性、時(shí)間的趨時(shí)性等,并從拐賣(mài)人口犯罪的主體特征、被害人特征、收買(mǎi)主 體特征等方面對(duì)拐賣(mài)人口犯罪其他基本特征進(jìn)行了詳細(xì)的分類(lèi)、歸納。 WP=4 第三部分系統(tǒng)地研究了當(dāng)代中國(guó)拐賣(mài)人口犯罪的形成原因。文章認(rèn)為,古代 社會(huì)傳統(tǒng)的婚嫁制度、封建主義思想觀念、傳宗接代的人性本能以及私有制構(gòu)成 了拐賣(mài)人口犯罪的歷史因素,經(jīng)濟(jì)發(fā)展的失衡、法制觀念的淡薄、防控機(jī)制的弱 化、買(mǎi)方市場(chǎng)的推動(dòng)以及跨國(guó)販賣(mài)的滲透構(gòu)成了當(dāng)代中國(guó)拐賣(mài)人口犯罪的現(xiàn)實(shí)因 素,而犯罪者的因素、被害人的被害性以及“買(mǎi)主”的原因則構(gòu)成了當(dāng)代中國(guó)拐 賣(mài)人口犯罪的個(gè)體因素,并進(jìn)一步指出貧窮和財(cái)富分配不均、性產(chǎn)業(yè)的繁榮和嬰 兒低出生率、巨額的利潤(rùn)刺激以及法律不健全,打擊不力是當(dāng)代國(guó)際拐賣(mài)人口犯 罪盛行的主要原因。 第四部分主要論述當(dāng)代中國(guó)拐賣(mài)人口犯罪的預(yù)防對(duì)策。文章認(rèn)為,應(yīng)從社會(huì) 的、法律的、組織的、個(gè)人的等方面對(duì)當(dāng)代中國(guó)拐賣(mài)人口犯罪進(jìn)行預(yù)防,并提出 了一些富于建設(shè)性的對(duì)策。
