【摘要】：黑社會(huì)犯罪、販毒和恐怖主義活動(dòng)已成為當(dāng)今世界三大犯罪災(zāi)難。近年來,隨著各國(guó)經(jīng)濟(jì)的發(fā)展和世界一體化步伐的加快,黑社會(huì)犯罪組織不僅在國(guó)內(nèi)發(fā)展壯大,還形成了跨國(guó)犯罪集團(tuán),大肆從事毒品走私、軍火販賣等違法犯罪活動(dòng),這給各國(guó)反黑工作造成很大困難,聯(lián)合國(guó)稱之為“全球性的瘟疫”。如何有效地打擊當(dāng)前黑惡勢(shì)力犯罪,成為各國(guó)學(xué)術(shù)界的一大課題。 由于世界各國(guó)、地區(qū)在地理環(huán)境、歷史背景、經(jīng)濟(jì)條件以及法制建設(shè)等方面的差異,其黑社會(huì)犯罪也呈現(xiàn)出不同的組織形態(tài)和發(fā)展趨勢(shì)。例如,歐美、意大利等國(guó)的黑手黨、日本的暴力團(tuán)以及我國(guó)港臺(tái)地區(qū)的各幫、派、盟、會(huì)等黑社會(huì)組織。雖然我國(guó)大陸還沒有出現(xiàn)典型的黑社會(huì)組織及其犯罪案件,但具有過渡色彩的黑社會(huì)性質(zhì)團(tuán)伙犯罪案件在我國(guó)呈逐年上升趨勢(shì),已經(jīng)嚴(yán)重危害了人民群眾的財(cái)產(chǎn)安全和社會(huì)穩(wěn)定,對(duì)和諧社會(huì)的建設(shè)產(chǎn)生了消極影響。各國(guó)黑社會(huì)犯罪不同的組織形態(tài)及發(fā)展趨勢(shì),決定了世界各國(guó)、地區(qū)在打擊黑惡勢(shì)力手段方面的差異,通過學(xué)習(xí)比較國(guó)際社會(huì)的反黑經(jīng)驗(yàn),將有助于對(duì)我國(guó)當(dāng)前階段反黑工作思考與檢視,排除狹隘的反黑觀念,拓寬反黑工作思路;通過對(duì)不同國(guó)家地區(qū)防治手段作比較分析,總結(jié)先進(jìn)的反黑經(jīng)驗(yàn),再結(jié)合我國(guó)實(shí)際情況,可以對(duì)我國(guó)當(dāng)前黑社會(huì)犯罪防治手段進(jìn)行完善,以期對(duì)我國(guó)打黑除惡工作的進(jìn)一步開展提供有益建議。
[Abstract]:Crime, drug trafficking and terrorism have become the three major crime disasters in the world. In recent years, with the development of the economy and the acceleration of the world integration, the criminal organizations in the underworld have not only developed in China, but also formed transnational criminal groups, which are illegal activities such as drug smuggling and arms trafficking. The anti black work in various countries has caused great difficulties. The United Nations called it "the global plague". How to effectively combat the crime of the current black and evil forces has become a major issue in the academic circles of all countries.
Because of the differences in geographical environment, historical background, economic conditions and the construction of legal system, the crime of black society also presents different organizational forms and development trends. For example, the Mafia in Europe, America, Italy and other countries, the Japanese violence group, and the gang, league, and the association of the Hong Kong and Taiwan areas in our country. However, there has not been a typical underworld organization and criminal cases in the mainland of China, but the crime of gangs with the nature of the transition is rising year by year in our country, which has seriously endangered the people's property security and social stability, and has a negative impact on the construction of a harmonious society. The organizational form and trend of development determine the difference between the world and the region in the fight against the means of the black and evil forces. By learning and comparing the anti black experience of the international community, it will help to think and examine the anti black work at the present stage of our country, eliminate the narrow concept of anti black and broaden the idea of anti black work, and through the prevention of the hands of different countries and regions. The section makes a comparative analysis, summarizes the advanced anti black experience, and then combined with the actual situation of our country, we can improve the current means of prevention and control of the crime in the underworld of our country, in order to provide some useful suggestions for the further development of our country's black and evil work.
