【摘要】：在我國(guó)，競(jìng)技體育屬于體育領(lǐng)域的一部分，競(jìng)技體育的發(fā)展促進(jìn)了體育事業(yè)的進(jìn)步。然而，由于一些人經(jīng)受不住金錢、名譽(yù)、利益的誘惑，甚至是虛榮心在作祟，在競(jìng)技體育比賽中做出了一系列的違法犯罪行為。由于我國(guó)的法律在規(guī)范競(jìng)技體育領(lǐng)域中的犯罪行為上還有待完善，以及我國(guó)的法律界和學(xué)術(shù)界對(duì)此領(lǐng)域的犯罪問題的研究也相對(duì)比較匱乏，所以導(dǎo)致了競(jìng)技體育領(lǐng)域中的許多犯罪行為都沒有受到其應(yīng)有的處罰，而是以行政處分的方式加以代替，這也是這些年我國(guó)競(jìng)技體育領(lǐng)域中的犯罪行為如此猖獗的原因。競(jìng)技體育領(lǐng)域中的犯罪大多都嚴(yán)重的侵害了他人或者社會(huì)的公共利益，擾亂了競(jìng)賽秩序，違反了刑法，，應(yīng)當(dāng)受到刑罰的處罰。筆者在下文中列舉了我國(guó)目前競(jìng)技體育領(lǐng)域中的犯罪的幾種主要的表現(xiàn)形式。從競(jìng)技體育事業(yè)的管理制度及立法現(xiàn)狀兩個(gè)角度對(duì)我國(guó)競(jìng)技體育領(lǐng)域中的犯罪行為進(jìn)行闡釋，在對(duì)競(jìng)技體育領(lǐng)域中的犯罪行為進(jìn)行預(yù)防的過程中可以吸取外國(guó)立法的先進(jìn)經(jīng)驗(yàn)，從法律及體育制度兩個(gè)角度對(duì)該類犯罪進(jìn)行預(yù)防。
[Abstract]:In our country, competitive sports is a part of sports field, and the development of competitive sports promotes the progress of sports cause. However, because some people can not withstand the temptation of money, reputation, interest, or even vanity, they have committed a series of illegal and criminal acts in competitive sports. Because the law of our country still needs to be perfected in regulating the criminal behavior in the field of competitive sports, and the research on the crime in this field is relatively scarce in the legal and academic circles of our country. Therefore, many crimes in the field of competitive sports have not been punished, but replaced by administrative sanctions, which is the reason why the crime in the field of competitive sports in China has been so rampant in recent years. Most of the crimes in the field of competitive sports have seriously infringed upon the public interests of others or the society, disturbed the order of competition, violated the criminal law, and should be punished by punishment. The author enumerates the main forms of crime in the field of competitive sports in China. In this paper, the author explains the criminal behavior in the field of competitive sports in China from the two angles of the management system and the current legislative situation of competitive sports, and can absorb the advanced experience of foreign legislation in the course of preventing the criminal behavior in the field of competitive sports. To prevent this kind of crime from the angle of law and sports system.
