【摘要】： 職務(wù)犯罪是腐敗現(xiàn)象的一種極端表現(xiàn)，受到黨和政府的高度重視，越來越成為學(xué)者們關(guān)注的焦點(diǎn)。本文是一篇筆者關(guān)于我國職務(wù)犯罪問題的拙作。 全文分前言、正文、結(jié)論三大部分。 前言部分簡要說明了我國目前職務(wù)犯罪的現(xiàn)狀，以及研究預(yù)防和懲治職務(wù)犯罪在理論和實(shí)踐上的重要意義。 正文部分有五個方面的內(nèi)容： 第一方面，論述了我國職務(wù)犯罪的概念和基本特征。分別從刑法學(xué)和犯罪學(xué)的角度分析了職務(wù)犯罪概念的內(nèi)容，然后根據(jù)該內(nèi)容淺析了職務(wù)犯罪主體特殊性和職務(wù)相關(guān)性的基本特征。 第二方面，闡述我國職務(wù)犯罪的特點(diǎn)和危害。在分析了職務(wù)犯罪大案要案增加幅度大、共同犯罪增多等特點(diǎn)的基礎(chǔ)上，，闡釋了職務(wù)犯罪對政治穩(wěn)定、經(jīng)濟(jì)發(fā)展、社會風(fēng)氣等的危害。 第三方面，從主、客觀兩方面探討了我國職務(wù)犯罪的成因。職務(wù)犯罪行為的發(fā)生除了客觀上存在的經(jīng)濟(jì)制度不完善，監(jiān)督機(jī)制、法制不健全等外界誘因外，還有行為人主觀上意志薄弱、心理失衡、罪責(zé)感差、法制觀念淡薄等個人內(nèi)在因素作用的結(jié)果。 第四方面，論述了我國職務(wù)犯罪預(yù)防的現(xiàn)狀。從職務(wù)犯罪預(yù)防的概念和特征出發(fā)，闡述了職務(wù)犯罪預(yù)防的重要性，同時，簡要總結(jié)了目前我國職務(wù)犯罪預(yù)防的工作機(jī)制和主要方法，對開展職務(wù)犯罪預(yù)防的成效和存在的主要問題作了論述。 第五方面，對職務(wù)犯罪的預(yù)防提出了幾點(diǎn)措施和思考。由于職務(wù)犯罪的形成是多種因素綜合作用的結(jié)果，因此，職務(wù)犯罪的預(yù)防需要政治、法律、道德等多種手段，發(fā)揮各自的功能作用，方能有效地治理。 結(jié)論部分進(jìn)一步說明了研究預(yù)防和懲治職務(wù)犯罪的現(xiàn)實(shí)意義，并對其前景進(jìn)行了展望。
[Abstract]:Job-related crime is an extreme manifestation of corruption, which has been attached great importance to by the Party and the government, and has become the focus of more and more scholars. The paper is divided into three parts: preface, text and conclusion. The preface briefly explains the present situation of duty crime in our country and the significance of studying the prevention and punishment of duty crime in theory and practice. There are five aspects in the text: On the one hand, it discusses the concept and basic characteristics of duty crime in China. From the perspective of criminal law and criminology, it analyzes the content of the concept of duty crime. Then, according to the content, it analyzes the basic characteristics of the particularity of the subject of duty crime and the relevance of duty. On the basis of analyzing the characteristics of the increase of major cases of duty crime and the increase of joint crime, this paper explains the political stability of duty crime. The harm of economic development, social atmosphere, etc Third, from the subjective and objective aspects, the author discusses the causes of our country's job-related crimes. The occurrence of job-related crimes in addition to the existence of an objective economic system is not perfect, supervision mechanism. Besides the external inducements, such as imperfect legal system, there are also the result of individual internal factors, such as weak subjective will, psychological imbalance, poor sense of guilt and responsibility, weak concept of legal system, and so on. In the aspect of 4th, this paper discusses the present situation of the prevention of job-related crime in China. From the concept and characteristics of the prevention of job-related crime, this paper expounds the importance of the prevention of job-related crime and at the same time. This paper briefly summarizes the working mechanism and main methods of the prevention of job-related crimes in China, and discusses the effectiveness and the existing problems of the prevention of job-related crimes. In the aspect of 5th, the author puts forward some measures and thoughts on the prevention of duty crime. Because the formation of duty crime is the result of many factors, therefore, the prevention of duty crime needs politics and law. Moral and other means, play their respective functions, can be effectively managed. The conclusion further explains the practical significance of the study on the prevention and punishment of duty crime, and prospects for its future.
