【摘要】：在中國(guó)特色社會(huì)主義法治體系的"頂層設(shè)計(jì)"下,憲法和黨章的關(guān)系應(yīng)當(dāng)作出合理而適切的安排。兩者應(yīng)當(dāng)是相互區(qū)別、相互呼應(yīng)、相得益彰的關(guān)系。從相互區(qū)別來看,憲法和黨章分屬不同的規(guī)范體系,由于各自性質(zhì)、約束對(duì)象、效力形式不同而不可將兩者混為一談。從相互呼應(yīng)來看,憲法和黨章在外在表現(xiàn)形態(tài)上呈現(xiàn)出一致性,憲法確立了黨的領(lǐng)導(dǎo)地位,黨章要求黨在憲法范圍內(nèi)活動(dòng),黨章所確立的治國(guó)理政的基本方略又成為憲法制定實(shí)施的基本指針。從相得益彰來看,憲法和黨章實(shí)質(zhì)統(tǒng)一于治國(guó)理政與從嚴(yán)治黨的實(shí)踐中,統(tǒng)一于"把權(quán)力關(guān)進(jìn)制度籠子"的客觀需求中,統(tǒng)一于"維護(hù)人民根本利益"的目標(biāo)追求中。
[Abstract]:Under the "top-level design" of the socialist legal system with Chinese characteristics, the relationship between the Constitution and the Party Constitution should be rationally and appropriately arranged. The two should be a relationship that distinguishes, echoes and complements each other. The Constitution and the Party Constitution belong to different normative systems, because of their respective nature, binding objects and different forms of effectiveness, they can not be confused. From the perspective of mutual echo, the Constitution and the Constitution show consistency in their external forms of expression. The Constitution establishes the leading position of the Party, and the Party Constitution requires the Party to act within the scope of the Constitution. The basic strategy of governing the country and administration established by the Party Constitution has become the basic guideline for the constitution formulation and implementation. From the point of view of mutual benefit, the constitution and the party constitution are United in the practice of governing the country and managing the party strictly, in the objective demand of "putting power in the cage of the system", and in the goal pursuit of "safeguarding the fundamental interests of the people".
