【摘要】：圍棋棋譜是指用圖和文字說明圍棋下法或解釋圍棋對(duì)局的書或圖譜。它既具有技術(shù)和思想功能,也具有藝術(shù)功能。前兩者不足以證明圍棋棋譜屬于著作權(quán)法上的"思想",后者則可以展現(xiàn)圍棋棋譜作為著作權(quán)法上"表達(dá)"的個(gè)性。圍棋棋譜屬于性質(zhì)上不可分割使用的合作作品,其著作權(quán)原則上歸屬于對(duì)弈雙方,但在世界大賽中歸屬于賽事組織者,在其他情形下則要兼顧俱樂部、賽事承辦方和賽事贊助商的優(yōu)先使用權(quán)。圍棋棋譜的著作權(quán)內(nèi)容包括著作人身權(quán)和與棋譜復(fù)制、出版、傳播相關(guān)的所有著作財(cái)產(chǎn)權(quán),這些權(quán)利受到一定形式的合理使用和法定許可的限制。
[Abstract]:Go spectrum refers to the use of pictures and words to explain the play of go or to explain the game of books or charts.It has not only technical and ideological functions, but also artistic functions.The former two are not enough to prove that the go spectrum belongs to the "thought" of copyright law, while the latter can show the personality of the "expression" of the go spectrum as the copyright law.The go spectrum is a cooperative work of an inseparable nature, the copyright of which belongs in principle to both sides of the game, but belongs to the organizer of the event in the world competition and, in other cases, to the club,Priority for event organizers and event sponsors.The copyright content of go spectrum includes the personal right of the author and the property rights of all works related to the reproduction, publication and dissemination of the chess spectrum. These rights are restricted by certain forms of reasonable use and legal permission.
