【摘要】：改革開放以來,我國的國土資源管理日臻成熟,但隨著社會經(jīng)濟的發(fā)展,國土資源管理也面臨著一些新問題：由于改革開放的深入及城鄉(xiāng)一體化的快速發(fā)展,在經(jīng)濟利益的刺激下,國土資源違法方式和手段也多樣化、復雜化和隱蔽化,執(zhí)法監(jiān)察難度不斷加大,表現(xiàn)為“違法行為發(fā)現(xiàn)難、違法事實查處難、查處決定執(zhí)行難”。造成上述“三難”的原因既有當前行政體制制約的原因,也有相關法律法規(guī)滯后于現(xiàn)實的原因,還有執(zhí)法人員能力和素質(zhì)不高的原因。這些問題迫切要求我國建立更為嚴格的國土資源管理制度,更好地適應我國經(jīng)濟社會快速發(fā)展的要求。本項研究對于強化耕地保護,加強國土資源管理,維護良好的國土資源管理秩序,促進國土資源節(jié)約集約利用具有重要的意義。本文通過研究共同責任機制的相關理論,從國土資源執(zhí)法監(jiān)察難的現(xiàn)實出發(fā),借鑒多地國土資源執(zhí)法監(jiān)察共同責任機制實施的經(jīng)驗,解析當前國土資源執(zhí)法監(jiān)察共同責任機制的現(xiàn)狀,探索國土資源執(zhí)法監(jiān)察共同責任機制理念基礎和歸責原則,從國土資源執(zhí)法監(jiān)察共同責任機制的責任主體和動力機制兩個方面對完善共同責任機制進行了一些研究。通過研究,提出了完善國土資源執(zhí)法監(jiān)察共同責任相關法規(guī)和制度、以利益為導向轉(zhuǎn)變地方政府行為、明確國土資源執(zhí)法監(jiān)察共同責任體系中各主體的責任、建立嚴厲的共同責任行政問責制度、強化執(zhí)法監(jiān)察隊伍依法行政能力、建立國土資源執(zhí)法監(jiān)管新模式等六個方面的對策和建議。
[Abstract]:Since the reform and opening up, the land and resources management of our country is becoming more and more mature, but with the development of social economy, the land and resources management is also facing some new problems: because of the deepening of reform and opening up and the rapid development of the integration of urban and rural areas, Stimulated by economic interests, the illegal ways and means of land and resources are also diversified, complicated and covert, and the difficulty of law enforcement and supervision is constantly increasing, which is manifested as: "it is difficult to find illegal acts and to investigate and deal with illegal facts." The reasons for the above-mentioned "three difficulties" are not only the reasons of the current administrative system constraints, but also the reasons that the relevant laws and regulations lag behind the reality. There are also reasons why the ability and quality of law enforcement personnel are not high. These problems urgently require China to establish a more stringent land and resources management system to better meet the requirements of rapid economic and social development in our country. It is of great significance to strengthen the management of land and resources, to maintain a good order of management of land and resources and to promote the intensive utilization of land and resources. Drawing lessons from the experience of implementing the common responsibility mechanism of land and resources law enforcement supervision in many places, this paper analyzes the present situation of the common responsibility mechanism of land and resources law enforcement supervision, and probes into the conceptual basis and imputation principle of the common responsibility mechanism of land and resources law enforcement supervision. From the two aspects of responsibility subject and motive mechanism of land and resources law enforcement supervision, this paper makes some research on the improvement of common responsibility mechanism. Through the research, it puts forward the relevant laws and regulations and systems to perfect the common responsibility of land and resources law enforcement and supervision. Taking the interests as the guide to change the behavior of the local government, clarifying the responsibilities of the main bodies in the common responsibility system of land and resources law enforcement supervision, establishing a strict system of mutual responsibility administrative accountability system, strengthening the ability of the law enforcement supervision team to administer according to law, The countermeasures and suggestions in six aspects, such as establishing a new mode of land and resources law enforcement and supervision.
