黃河流域水資源協(xié)同治理研究

【摘要】:水資源是人類生存、社會(huì)發(fā)展的基礎(chǔ)性自然資源和戰(zhàn)略性經(jīng)濟(jì)資源。近年來(lái),我國(guó)水污染事件頻發(fā),這樣的情況下水資源的管理顯得尤為重要。水資源的流域特性,決定其需要以流域?yàn)閱卧M(jìn)行統(tǒng)一管理。而我國(guó)單一制的政治結(jié)構(gòu)下行政區(qū)域是國(guó)家政治、經(jīng)濟(jì)、社會(huì)活動(dòng)的基本單元,對(duì)水資源實(shí)行區(qū)域管理。在這樣的政治背景下,水資源作為準(zhǔn)公共物品存在負(fù)外部性和地方保護(hù)主義的問(wèn)題,因此,應(yīng)該對(duì)水資源進(jìn)行流域與區(qū)域的協(xié)同治理。針對(duì)20世紀(jì)70年代開始的黃河流域斷流問(wèn)題國(guó)家實(shí)行的流域統(tǒng)一調(diào)度政策起到了明顯的作用,說(shuō)明流域統(tǒng)一管理對(duì)于解決流域問(wèn)題更有效。通過(guò)完善流域管理機(jī)構(gòu)的設(shè)置、配套法律制度,明確其法律地位,加強(qiáng)其管理職權(quán),達(dá)到與地方政府平等的地位才能實(shí)現(xiàn)流域與區(qū)域的協(xié)同治理。在國(guó)家“持續(xù)推進(jìn)政府職能轉(zhuǎn)變”的改革進(jìn)程中,政府不僅要讓渡出來(lái)一定的職能范圍,還要正確引導(dǎo)社會(huì)公眾積極參與進(jìn)來(lái),從法制、行政、市場(chǎng)、公眾等各方面實(shí)現(xiàn)全社會(huì)對(duì)水資源的協(xié)同治理。本文運(yùn)用公共資源治理理論和近年來(lái)興起的協(xié)同治理理論,以黃河流域水資源治理體制為對(duì)象,結(jié)合我國(guó)的社會(huì)與制度實(shí)際,探討現(xiàn)行治理體制的特點(diǎn)、治理困境以及成因,并在此基礎(chǔ)上提出一些改進(jìn)舉措。當(dāng)前黃河流域水資源治理中,存在法律規(guī)范不完善,流域管理機(jī)構(gòu)自身機(jī)構(gòu)定位不清,條塊分割矛盾明顯,九龍治水亂象突出,流域管理機(jī)構(gòu)缺乏有效執(zhí)行權(quán)力,動(dòng)員社會(huì)參與能力嚴(yán)重不足等問(wèn)題,科層制的組織體系依靠自身很難克服這些困難;趨f(xié)同治理理論視角,論文最后指出了黃河流域水資源實(shí)現(xiàn)協(xié)同治理的具體路徑,主要包括:改革黃河流域水資源管理體制運(yùn)行機(jī)制,增強(qiáng)流域管理機(jī)構(gòu)服務(wù)職能,通過(guò)立法加強(qiáng)流域管理機(jī)構(gòu)職權(quán),積極引導(dǎo)社會(huì)力量共同參與到黃河流域水資源治理過(guò)程之中。
[Abstract]:Water resources are the basic natural resources and strategic economic resources for human survival and social development. In recent years, water pollution incidents occur frequently in China, so the management of water resources is very important. The watershed characteristics of water resources determine the need for unified management of the basin. The administrative region is the basic unit of national politics, economy and social activities under the political structure of single system in our country, and regional management of water resources is carried out. Under such political background, there are negative externalities and local protectionism in water resources as quasi-public goods. The unified regulation policy of the Yellow River basin, which was implemented in the Yellow River basin since 1970s, has played an obvious role, which shows that the unified watershed management is more effective to solve the basin problems. By perfecting the establishment of watershed management organization, supporting legal system, clarifying its legal status, strengthening its management authority, and achieving equal status with local government, the coordinated management of watershed and region can be realized. In the course of the state's reform of "continuously promoting the transformation of government functions," the government should not only cede a certain range of functions, but also correctly guide the public to participate actively, from the legal system, the administration, and the market. The public and other aspects of the implementation of the whole society of water resources coordinated management. This paper applies the theory of public resource governance and the theory of cooperative governance that has arisen in recent years, taking the water resources management system of the Yellow River basin as the object, combining the social and institutional reality of our country, discusses the characteristics, difficulties and causes of the current governance system. And on this basis put forward some improvement measures. At present, in the management of water resources in the Yellow River basin, there are imperfect laws and regulations, unclear positioning of the watershed management agencies themselves, obvious contradictions in the division of blocks, prominent chaos in the control of water resources in Kowloon, and lack of effective executive power of the river basin management agencies. It is difficult to overcome these problems on the basis of its own organization system because of the serious insufficiency of its ability to mobilize social participation. Based on the theory of collaborative governance, the paper finally points out the specific ways to achieve coordinated management of water resources in the Yellow River basin, including: reforming the operational mechanism of the water resources management system of the Yellow River basin, and strengthening the service function of the watershed management institutions. Through legislation to strengthen the authority of river basin management institutions, actively guide social forces to participate in the Yellow River basin water resources management process.
