【摘要】：自上世紀(jì)80年代初,我國(guó)開(kāi)始推行招投標(biāo)制度以來(lái),我國(guó)建設(shè)項(xiàng)目招投標(biāo)事業(yè)發(fā)展迅速,招投標(biāo)項(xiàng)目的數(shù)量與資金總量都在不斷增加,這對(duì)于繁榮我國(guó)建設(shè)市場(chǎng),建立起市場(chǎng)競(jìng)爭(zhēng)機(jī)制,打破地區(qū)、行業(yè)的限制和保護(hù)主義、維護(hù)各競(jìng)爭(zhēng)主體的合法權(quán)益、保護(hù)投資主體的利益,節(jié)約了工程投資,提高建設(shè)工程質(zhì)量,都有著非常重要的意義。 推行發(fā)展30年后,招投標(biāo)已經(jīng)發(fā)展成為我國(guó)建設(shè)工程市場(chǎng)的一種主要交易方式。在招投標(biāo)制度的發(fā)展過(guò)程中,為了規(guī)范招標(biāo)投標(biāo)活動(dòng),我國(guó)在2000年1月1日頒布實(shí)施了《中華人民共和國(guó)招標(biāo)投標(biāo)法》,并在12年2月1日頒布實(shí)施了《中華人民共和國(guó)招標(biāo)投標(biāo)法實(shí)施條例》。 然而,隨著社會(huì)經(jīng)濟(jì)的進(jìn)一步發(fā)展,招投標(biāo)市場(chǎng)中尚存在許多不規(guī)范的做法.當(dāng)前在招投標(biāo)工作中還存在許多問(wèn)題和不足,嚴(yán)重影響了招投標(biāo)制度作用的發(fā)揮,使得招投標(biāo)法的貫徹和執(zhí)行不能徹底到位。 建設(shè)市場(chǎng)招投標(biāo)活動(dòng)的不規(guī)范,缺乏有效的約束和保障機(jī)制,相關(guān)法律法規(guī)的不完善,使招投標(biāo)制度不能充分發(fā)揮其作用。所以,本文針對(duì)如何進(jìn)一步規(guī)范招標(biāo)行為進(jìn)行了深入的探討,提出了相關(guān)的對(duì)策,以期為工程建設(shè)的更好實(shí)施提供有力的幫助。 本文主要從兩個(gè)大的方面進(jìn)行分析研究：一是招投標(biāo)制度方面的完善與規(guī)范,二是招投標(biāo)活動(dòng)中人的行為規(guī)范化研究。系統(tǒng)的闡述了招標(biāo)制度在國(guó)內(nèi)外的實(shí)施近況,并對(duì)彼此之間的差異進(jìn)行了分析,分別從招標(biāo)、投標(biāo)、評(píng)標(biāo)等方面分析其中存在的問(wèn)題,提出了相應(yīng)的改進(jìn)辦法,提供了一些可行的建議。
[Abstract]:Since the beginning of the 1980s, when China began to implement the bidding and tendering system, the bidding and tendering undertakings of construction projects in China have developed rapidly. The number and total amount of funds for bidding and tendering projects have been increasing continuously. This will help to prosper China's construction market, establish a market competition mechanism, break the restrictions and protectionism of regions, industries, and safeguard the main competitors. Legitimate rights and interests, protection of the interests of the main investors, saving investment in projects, improving the quality of construction projects, are of great significance.
After 30 years of development, bidding has developed into a major mode of transaction in China's construction market. In order to standardize bidding activities, China promulgated and implemented the Law of the People's Republic of China on Bidding and Bidding on January 1, 2000, and promulgated and implemented the Law of the People's Republic of China on February 1, 12. However, with the further development of social economy, there are still many irregular practices in the bidding market. At present, there are still many problems and shortcomings in the bidding work, seriously affecting the role of the bidding system, making the implementation and implementation of the bidding law can not be thoroughly in place.
The non-standard bidding activities in the construction market, the lack of effective restraint and guarantee mechanism, the imperfection of relevant laws and regulations, so that the bidding system can not give full play to its role. Powerful help.
This paper mainly analyzes and studies from two aspects: one is the perfection and standardization of the bidding system, the other is the standardization of the behavior of people in the bidding activities.It systematically expounds the recent situation of the implementation of the bidding system at home and abroad, and analyzes the differences between them, respectively from the aspects of bidding, bidding, bid evaluation and so on. The existing problems, put forward the corresponding improvement measures, and provide some feasible suggestions.
