【摘要】：建設項目安全文明生產,是建筑行業(yè)健康良好發(fā)展的基本保障,是社會文明進步的重要表現。黨和政府為提高我國建筑業(yè)職業(yè)安全健康水平,降低建設項目生產安全事故發(fā)生率,制定出臺多項法律法規(guī)政策以及相關行業(yè)標準,以完善建設項目安全生產監(jiān)管工作。由于建筑行業(yè)的特殊性,目前仍無法有效防止建筑生產安全事故的發(fā)生,減少人員傷亡和經濟損失,種種問題嚴重制約著我國建筑業(yè)的進一步健康發(fā)展。尋找適合我國國情的政府安全監(jiān)管路徑、模式有著極為重要的現實意義。 本文以政府角度,從建筑安全管理法律體系、監(jiān)督機構設置、管理職能、管理內容、管理方式五個方面對政府建筑安全監(jiān)督管理現狀進行分析。對發(fā)達國家和地區(qū)法律法規(guī)和政府監(jiān)管體系、監(jiān)督機構設置和人員配備、對違法違規(guī)行為的處罰力度、政府監(jiān)管部門先進監(jiān)督技術手段等方面進行總結歸納,為論文結論的提出以及切實改善我國建筑行業(yè)安全生產環(huán)境提供參考。 從建筑施工從業(yè)人員、施工現場組織管理、參建企業(yè)管理機制三個角度分析了現場施工安全事故多發(fā)的原因。基于建筑安全生產政府監(jiān)管現狀分析,得出我國當前建筑安全生產監(jiān)管法律體系不健全,政府監(jiān)管部門工作職能履行效率低,監(jiān)管工作不力、執(zhí)法不規(guī)范,監(jiān)管工作隊伍薄弱,安全事故信息統(tǒng)計真實性透明性缺失,監(jiān)督管理手段落后的政府監(jiān)管失位原因。 運用博弈論原理,通過分析政府監(jiān)管部門與建設施工承包商之間的博弈關系,得出以數學角度減少承包商違法違規(guī)行為的直接方法為提高對其處罰力度,以及基于利益機制角度通過優(yōu)化監(jiān)督機構設置和人員配備、使用先進監(jiān)督技術手段等方法進一步提高政府監(jiān)管工作效率、和相關法律法規(guī)政策制定與實施,是降低建筑安全事故發(fā)生率最有效的途徑。 通過博弈分析,總結、借鑒發(fā)達國家和地區(qū)監(jiān)管方法及經驗,本文從完善法律法規(guī)體系,優(yōu)化監(jiān)督機構設置,加強監(jiān)督部門人員隊伍建設,豐富監(jiān)管手段和提高監(jiān)管方式的科技化、信息化五個方面,對進一步加強政府相關監(jiān)管部門對建筑安全生產的監(jiān)督管理工作,優(yōu)化建筑施工生產環(huán)境境,促進我國建筑業(yè)持續(xù)健康良好發(fā)展提出建設性對策。
[Abstract]:The safe and civilized production of construction projects is the basic guarantee for the healthy development of the construction industry and the important manifestation of the progress of social civilization. In order to improve the occupational safety and health level of construction industry and reduce the incidence of production safety accidents in construction projects, the Party and the government have formulated a number of laws, regulations and policies as well as relevant industry standards to improve the supervision and control of construction projects in production safety. Because of the particularity of the construction industry, it is still unable to effectively prevent the occurrence of construction safety accidents, reduce casualties and economic losses, and all sorts of problems seriously restrict the further healthy development of the construction industry in our country. It is of great practical significance to find a suitable way for government safety supervision in our country. From the angle of government, this paper analyzes the present situation of government building safety supervision and management from five aspects: the legal system of building safety management, the establishment of supervision agencies, the management functions, the management contents and the management methods. Summarizing and summarizing the laws, regulations and government supervision systems of developed countries and regions, the establishment and staffing of supervisory bodies, the degree of punishment for violations of laws and regulations, the advanced technical means of supervision and control by government regulators, etc. It provides a reference for the conclusion of the paper and the improvement of the safe production environment of the construction industry in China. This paper analyzes the causes of the frequent accidents in the construction field from three angles: the construction workers, the construction site organization and management, and the management mechanism of the participating enterprises. Based on the analysis of the current situation of government supervision on construction safety production, it is concluded that the current legal system of construction safety supervision in China is not perfect, the work function of government supervision department is inefficient, the supervision work is not effective, the law enforcement is not standardized, and the supervision team is weak. The lack of transparency of statistical authenticity of safety accident information and the lack of supervision and management means lead to the loss of government supervision. By analyzing the game relationship between the government supervision department and the construction contractor, the direct way to reduce the illegal behavior of the contractor from the mathematical angle is to improve the punishment intensity by using the game theory principle, and by analyzing the game relation between the government supervision department and the construction contractor. And from the angle of interest mechanism, we can further improve the efficiency of government supervision by optimizing the setting and staffing of supervisory bodies, using advanced supervision techniques, and making and implementing relevant laws, regulations and policies. It is the most effective way to reduce the incidence of building safety accidents. Through game analysis, this paper summarizes and draws lessons from the methods and experiences of supervision in developed countries and regions, from perfecting the system of laws and regulations, optimizing the setting up of supervision organizations, strengthening the construction of personnel of supervisory departments. To enrich the means of supervision and to improve the scientific and technological aspects of supervision and management, to further strengthen the supervision and management of construction safety production by relevant government regulators, and to optimize the environment of construction and production. To promote the sustainable and healthy development of China's construction industry put forward constructive countermeasures.
