【摘要】：在經(jīng)濟(jì)全球化和信息公開化的時代,信息資源成為社會經(jīng)濟(jì)發(fā)展的重要決定因素。政府環(huán)境信息既是公眾了解環(huán)保部門行為的直接途徑,也是公眾履行監(jiān)督權(quán)利的重要依據(jù)。當(dāng)前,針對政府環(huán)境信息公開的研究比比皆是,而專門針對環(huán)境信息依申請公開的研究卻鳳毛麟角。當(dāng)前,我國政府環(huán)境信息依申請公開的實施現(xiàn)狀如何?在發(fā)展過程中遇到那些瓶頸和阻礙,這些都將是本文所要研究的問題重點。本文在闡述政府環(huán)境公共權(quán)力理論、知情權(quán)理論的基礎(chǔ)上,運用文獻(xiàn)分析法、實證研究法和比較分析法等,對我國28個省區(qū)市政府環(huán)境信息依申請公開過程中的實施狀況進(jìn)行分析。本文共分為四大部分,六個章節(jié)。第一部分:引言。主要簡述本論文的研究研究意義、研究方法,并對政府環(huán)境信息公開、環(huán)境信息依申請公開的國內(nèi)外研究情況作出相關(guān)評述。第二部分:第二章。該部分概述了本文的相關(guān)理論基礎(chǔ)和基本概念,闡釋了我國政府環(huán)境信息公開依申請公開政策法規(guī)發(fā)展歷程,簡單明晰當(dāng)前我國環(huán)境信息依申請公開的法律原則。第三部分:第三、四、五章。該部門是本文的重點部分,是對當(dāng)前我國28個省級政府環(huán)境信息依申請公開的實施現(xiàn)狀進(jìn)行實證分析,表明當(dāng)前我國環(huán)境信息依申請公開的實施現(xiàn)狀、申請公開過程中存在的問題以及原因。第四部分,第六章。在這一章,作者對優(yōu)化我國政府環(huán)境信息依申請公開中的相應(yīng)問題提出相關(guān)對策。
[Abstract]:In the era of economic globalization and information openness, information resources have become an important determinant of social and economic development. Government environmental information is a direct way for the public to understand the behavior of environmental protection departments. It is also an important basis for the public to carry out the right to supervise. At present, researches on the disclosure of government environmental information abound, while research specifically on the disclosure of environmental information according to application is rare. At present, What is the status quo of the implementation of the environmental information of our government according to the application? In the process of development, the bottlenecks and obstacles will be the focus of this paper. Based on the elaboration of the theory of government environmental public power and the theory of the right to know, this paper applies the literature analysis method. Empirical research and comparative analysis are used to analyze the implementation of environmental information in 28 provinces, autonomous regions and municipalities in China. This paper is divided into four parts. Six chapters. The first part: introduction. This paper mainly describes the research significance, research methods, and the disclosure of government environmental information, The second part: chapter two. This part summarizes the theoretical basis and basic concepts of this paper. This paper expounds the development course of government environmental information openness according to the policies and regulations of application for publicity, and clarifies the legal principles of environmental information disclosure in our country at present. The third part: chapter three, four and five. The department is the key part of this paper. It is an empirical analysis of the current implementation situation of 28 provincial governments' environmental information disclosure according to application, which shows that the current implementation status of environmental information disclosure according to application, the problems existing in the process of application for disclosure and the reasons for it. Part 4th. Chapter 6th. In this chapter, the author puts forward the relevant countermeasures to optimize the government environmental information disclosure in accordance with the application.
