【摘要】：隨著海洋強(qiáng)國(guó)戰(zhàn)略的逐步推進(jìn),中國(guó)海洋執(zhí)法體制重構(gòu)已正式提上議事日程。體制重構(gòu)是一項(xiàng)涉及多要素、多進(jìn)程的系統(tǒng)工程,既要著眼未來(lái),又要立足現(xiàn)實(shí),還要繼承過(guò)往。制度環(huán)境是制度制定無(wú)法回避的因素,海洋執(zhí)法體制重構(gòu)應(yīng)當(dāng)注重背景因素的研究并盡量與其契合。一國(guó)海洋執(zhí)法體制的建構(gòu)不是孤立的,也不是任意的,應(yīng)當(dāng)在科學(xué)判斷國(guó)際形勢(shì)、周邊局勢(shì)的前提下,合理確定海洋執(zhí)法重構(gòu)的方向與原則,在準(zhǔn)確定位國(guó)內(nèi)政治、經(jīng)濟(jì)態(tài)勢(shì)的前提下,合理選擇海洋執(zhí)法體制重構(gòu)的模式與目標(biāo),在深刻把握海洋開(kāi)發(fā)與管理行業(yè)規(guī)律的前提下,合理借鑒海洋管理領(lǐng)域的國(guó)際慣例和域外成熟經(jīng)驗(yàn)。
[Abstract]:With the development of the strategy of ocean power, the reconstruction of China's maritime law enforcement system has been put on the agenda.System reconstruction is a system engineering involving many elements and processes. It not only focuses on the future, but also bases on reality and inherits the past.The institutional environment is an unavoidable factor in institution making, and the reconstruction of marine law enforcement system should pay attention to the research of background factors and accord with it as much as possible.The construction of a country's maritime law enforcement system is neither isolated nor arbitrary. On the premise of scientifically judging the international situation and the surrounding situation, we should reasonably determine the direction and principles for the reconstruction of maritime law enforcement, and accurately position domestic politics.On the premise of economic situation, we should rationally choose the mode and target of the reconstruction of marine law enforcement system, and on the premise of deeply grasping the law of marine development and management, we can use international practice and overseas mature experience in marine management field for reference.
