【摘要】：從陳永洲判刑到郭振璽被抓,再到21世紀(jì)網(wǎng)新聞敲詐案件的曝光,中國“新聞尋租”現(xiàn)象及其造成的惡性互動效果正在滲透到報業(yè)?電視?網(wǎng)絡(luò)等多個領(lǐng)域,廣告新聞?車馬費?提成費?有償監(jiān)督?封口費等多種新聞尋租業(yè)態(tài)不斷發(fā)酵,并呈現(xiàn)出從個人尋租到組織尋租的蔓延趨勢,作為“社會公器”的媒體,深陷“左手權(quán)力,右手利潤”的悖論,公信力大大下降?本文結(jié)合上述媒體生態(tài)環(huán)境,首先對中國新聞尋租的歷史演變開展研究,然后通過案例梳理分析當(dāng)前新聞尋租的形式和根源,從新聞尋租的縱橫坐標(biāo)來立體剖析這一現(xiàn)象的來龍去脈及表現(xiàn)形態(tài),然后在政府規(guī)制層面尋求解決方案,這一部分是通過文本、案例等方式解讀政府規(guī)制在新聞尋租方面的失靈現(xiàn)狀,繼而探討在中國特殊語境下,新聞尋租的政府規(guī)制面臨哪些內(nèi)外困難,如何在借鑒國外新聞評議會?同業(yè)批評?職業(yè)道德建設(shè)等先進(jìn)經(jīng)驗的同時,探索具有中國特色的媒體規(guī)制模式,通過以憲法為基礎(chǔ)的行業(yè)法形式,明確媒體權(quán)責(zé)邊界,防止新聞報道的異化,同時也使黨管媒體進(jìn)一步規(guī)范化?制度化,逐漸實現(xiàn)從管制到治理的轉(zhuǎn)變?從產(chǎn)業(yè)規(guī)制角度說,媒體產(chǎn)權(quán)主體的缺位?以及新聞人身份的多元化,使得中國業(yè)界對新聞尋租的“行業(yè)內(nèi)控”不足,也阻礙了“紙上政令”的現(xiàn)實執(zhí)行動力;媒體在具有經(jīng)濟(jì)人屬性的同時,卻沒有完善的法人治理結(jié)構(gòu),亦使得”新聞尋租”呈現(xiàn)出和“國企腐敗”類似的復(fù)雜業(yè)態(tài)?因此,本文提出,新聞尋租的政府規(guī)制須謹(jǐn)防“一放就亂,一管就死”,可參考國企改革經(jīng)驗來開展媒體體制改革,在把控整體輿論導(dǎo)向的前提下,明晰產(chǎn)權(quán)主體?董事會試點?完善員工持股?職業(yè)經(jīng)理人制度等,實現(xiàn)媒介社會效益和經(jīng)濟(jì)效益的雙重兼顧?本文從政治、經(jīng)濟(jì)、文化、社會等多重角度分析新聞尋租的原因和政府規(guī)制的難點,對策建議相對綜合全面,在記者準(zhǔn)入和退出機制、試點公共媒體、新聞法“因事成制”、仿照國企改革開展媒體改革等方面,具有一定前瞻性和現(xiàn)實針對性。中國傳媒正處于大變局時期,傳媒業(yè)價值亟待重建,新聞專業(yè)主義有待回歸,只有使新聞最大限度回歸人民言論自由的本質(zhì),才能使新聞媒體真正成為“輿論監(jiān)督,群眾喉舌,政府鏡鑒,改革尖兵”?
[Abstract]:From Chen Yongzhou's sentence to Guo Zhenxi's arrest, to the exposure of news extortion cases in the 21st century, is the phenomenon of "news rent-seeking" in China and its vicious interactive effects permeating the newspaper industry?TV?Internet and other areas, advertising news?Horses?Royalty?Paid supervision?Seal fees and other forms of news rent-seeking continue to ferment and present a spreading trend from individual rent-seeking to organizational rent-seeking. As a "social public tool," the media is trapped in the paradox of "left-handed power, right-handed profit", and its credibility is greatly reduced?Based on the above-mentioned media ecological environment, this paper first studies the historical evolution of Chinese news rent-seeking, and then analyzes the forms and root causes of current news rent-seeking through a case study.From the vertical and horizontal coordinates of news rent-seeking to analyze the origin and manifestation of this phenomenon, and then in the level of government regulation to find a solution, this part is through the text,This paper analyzes the failure of government regulation in news rent-seeking, and then discusses what internal and external difficulties the government regulation of news rent-seeking is facing in the special context of China, and how to learn from foreign news consultative councils.Peer criticism?At the same time, we should explore the media regulation mode with Chinese characteristics, define the boundary of media power and responsibility through the form of constitution-based industry law, and prevent the alienation of news reports.At the same time, the Party also further standardized the management of the media?Institutionalization and gradual transition from regulation to governance?From the perspective of industrial regulation, the absence of media property rights?As well as the diversity of journalistic identity, the lack of "industry internal control" over news rent-seeking in China has also hindered the realistic implementation of the "order on paper." while the media has the attribute of "economic man,"But there is no perfect corporate governance structure, so that "news rent-seeking" and "state-owned enterprise corruption" similar to the complex business situation?Therefore, this paper suggests that the government regulation of news rent-seeking should be on guard against "disorderly as soon as possible, and die as soon as possible". Can we consult the experience of state-owned enterprise reform to carry out the reform of the media system, and under the premise of guiding the public opinion to control the whole, we should clarify the subject of property right?Board pilot?Perfect employee Stock ownership?Professional manager system, to achieve both social and economic benefits of the media?This paper analyzes the reasons of news rent-seeking and the difficulties of government regulation from the angle of politics, economy, culture, society, and so on. The countermeasures and suggestions are relatively comprehensive, in the mechanism of access and withdrawal of journalists, in the pilot public media, and in the press law.Follow the reform of state-owned enterprises to carry out media reform and other aspects, with a certain foresight and realistic pertinence.The Chinese media is in a period of great change, the value of the media industry needs to be rebuilt urgently, and journalism professionalism needs to be returned. Only by maximizing the return of the news to the essence of the people's freedom of speech can the news media truly become "supervision by public opinion and mouthpiece of the masses."The Government has learned from the reform of the sharp army.
