【摘要】：伴隨著國際知識(shí)產(chǎn)權(quán)的逐漸強(qiáng)化的趨勢(shì)和各國圖書館事業(yè)的蓬勃發(fā)展，公共借閱權(quán)制度逐漸浮出水面，引起我們的重視。所謂公共借閱權(quán)就是著作權(quán)人或鄰接權(quán)人因其版權(quán)作品或版權(quán)制品被公共圖書館免費(fèi)借閱而獲得一定補(bǔ)償報(bào)酬的權(quán)利。1992年歐盟各國政治經(jīng)濟(jì)法律實(shí)行一體化，同年底歐盟頒布了《知識(shí)產(chǎn)權(quán)領(lǐng)域中的出租權(quán)、出借權(quán)及某些鄰接權(quán)的指令》，公共借閱權(quán)制度在許多歐洲國家如雨后春筍般地迅速建立，受世界知識(shí)產(chǎn)權(quán)的中心——?dú)W盟的影響，世界其他國家也紛紛開始探討建立公共借閱權(quán)制度的可能性。公共借閱權(quán)制度的歷史并不算久遠(yuǎn)，只有半個(gè)多世紀(jì)，而作為僅次于斯堪的納維亞國家較早實(shí)施公共借閱權(quán)制度的國家，荷蘭、德國、英國的公共借閱權(quán)歷史也基本代表了公共借閱權(quán)的整個(gè)歷史，，同時(shí)作為公共借閱權(quán)準(zhǔn)版權(quán)模式最成功的代表——英國，著作專有權(quán)的代表——德國，以及貫徹執(zhí)行EC92/100指令最為徹底的荷蘭，三個(gè)國家的公共借閱權(quán)制度獨(dú)具特色，對(duì)我國的借鑒作用多，值得我們進(jìn)一步地探討研究。文章就荷蘭、德國、英國三個(gè)國家的公共借閱權(quán)制度的發(fā)展歷程、立法模式、管理機(jī)構(gòu)、權(quán)利主體、權(quán)利客體內(nèi)容、補(bǔ)償金來源渠道、補(bǔ)償金計(jì)算方式及分配規(guī)則進(jìn)行一番詳述，比較他們的共性和異性，以期對(duì)我國未來建立屬于自己國家的公共借閱權(quán)制度提供經(jīng)驗(yàn)。
[Abstract]:With the gradual strengthening of international intellectual property rights and the vigorous development of libraries in various countries, the system of public borrowing right has gradually surfaced. The so-called public borrowing right is the right of copyright owners or neighboring rights to receive certain compensation for their copyright works or copyright products borrowed free of charge by public libraries. In 1992, the political, economic and economic laws of all countries in the European Union were integrated. At the end of the same year, the European Union issued the Directive on Lease Rights, loan Rights and certain neighboring Rights in the Field of intellectual property Rights. The system of public borrowing rights was quickly established in many European countries and was influenced by the European Union, the center of intellectual property rights in the world. Other countries around the world have also begun to explore the possibility of establishing a system of public borrowing rights. The history of public borrowing rights in the Netherlands, Germany and Britain, which is second only to Scandinavian countries in implementing the public borrowing right system earlier, basically represents the whole history of public borrowing right. At the same time, as the most successful representative of the quasi-copyright mode of public borrowing right-Britain, the representative of the exclusive right of works-Germany, and the Netherlands, which implements the EC92/100 directive most thoroughly, the public borrowing right system of the three countries has its own characteristics. The article discusses the development of public borrowing right system in the Netherlands, Germany and Britain, the legislative model, the administrative organization, the subject of rights, the content of the object of right, and so on. The sources of compensation, the calculation of compensation and the rules of distribution are described in detail to compare their commonalities and differences in order to provide experience for the establishment of the public borrowing right system in our country in the future.
