【摘要】:動(dòng)物源性食品作為食品的重要組成部分,其在提高人民生活水平、改變?nèi)藗冿嬍辰Y(jié)構(gòu)的同時(shí),為農(nóng)民增收、經(jīng)濟(jì)發(fā)展、出口創(chuàng)匯奠定了堅(jiān)實(shí)基礎(chǔ)。然而,隨著經(jīng)濟(jì)社會發(fā)展,動(dòng)物源性食品在數(shù)量與品種大量豐富的同時(shí),其食品安全質(zhì)量卻愈發(fā)堪憂,近年來,隨著"瘦肉精"、"毒奶粉"、"紅心蛋"等一系列食品安全事件曝光,動(dòng)物源性食品安全不斷挑戰(zhàn)著公眾的認(rèn)知底線,在嚴(yán)重威脅、影響人民生命權(quán)、健康權(quán)的同時(shí),對我國的對外貿(mào)易亦產(chǎn)生了不良影響。因此,加強(qiáng)動(dòng)物源性食品安全法律規(guī)制,保障我國動(dòng)物源性食品安全,不僅是維護(hù)人民生命健康權(quán)益的迫切需要,更是促進(jìn)我國畜牧業(yè)可持續(xù)發(fā)展和我國政治經(jīng)濟(jì)社會穩(wěn)定的迫切需要。本文以動(dòng)物源性食品安全法律規(guī)制為研究對象,通過文獻(xiàn)研究、規(guī)范分析、案例分析等方法,多角度、多方位開展研究:第一部分為引言,主要闡述動(dòng)物源性食品安全法律規(guī)制的背景、目的及意義等;第二部分是對動(dòng)物源性食品安全法律規(guī)制理論的簡要探討,明確了動(dòng)物源性食品、動(dòng)物源性食品安全、法律規(guī)制等基本概念;第三部分主要論述了我國動(dòng)物源性食品安全所面臨的問題及其影響因素;第四部分分析了我國動(dòng)物源性食品安全法律規(guī)制現(xiàn)狀及其存在的問題;第五部分列舉了國外先進(jìn)國家動(dòng)物源性食品安全法律規(guī)制的先進(jìn)成果;第六部分通過國內(nèi)外動(dòng)物源性食品安全法律規(guī)制的對比分析,針對我國國情,提出可行性應(yīng)對對策。希望通過本文的相關(guān)研究,能夠?qū)ν苿?dòng)我國動(dòng)物源性食品安全法律規(guī)制有一定幫助。
[Abstract]:As an important part of food, animal food not only improves people's living standard and changes people's dietary structure, but also lays a solid foundation for farmers' income, economic development and export to earn foreign exchange. However, with the development of economy and society, While the quantity and variety of animal-derived foods are abundant, their food safety quality has become increasingly worrying. In recent years, with the exposure of a series of food safety incidents such as "lean meat essence", "poisonous milk powder", "red heart egg" and so on, Food safety of animal origin constantly challenges the public's cognitive bottom line, and it affects people's right to life and health seriously, and at the same time, it has a negative impact on our country's foreign trade. Therefore, it is necessary to strengthen the legal regulation of animal origin food safety. Safeguarding the safety of animal origin food in China is not only an urgent need to safeguard the people's rights and interests in life and health, It is also an urgent need to promote the sustainable development of animal husbandry and the political, economic and social stability of our country. This paper takes the legal regulation of animal origin food safety as the research object, through the methods of literature research, normative analysis, case analysis, and so on, from various angles. The first part is the introduction, mainly elaborates the background, the purpose and the significance of the animal origin food safety legal regulation; the second part is the brief discussion to the animal origin food safety legal regulation theory, the second part is the brief discussion to the animal origin food safety legal regulation theory, The basic concepts of animal origin food, animal origin food safety, legal regulation and so on are clarified. The third part mainly discusses the problems and influencing factors of animal origin food safety in China. The fourth part analyzes the current situation and existing problems of the legal regulation of animal origin food safety in China, the fifth part enumerates the advanced achievements of animal origin food safety legal regulation in foreign advanced countries. The sixth part through the domestic and foreign animal origin food safety legal regulation contrast analysis, according to our country situation, proposed the feasibility countermeasure. Can promote our country animal origin food safety legal regulation has certain help.
