【摘要】：在現(xiàn)代市場經(jīng)濟(jì)條件下,政府以公共規(guī)制的方式廣泛介入市場領(lǐng)域,克服市場自發(fā)運(yùn)行導(dǎo)致的各種扭曲和不公,已成為各國政府的一項(xiàng)經(jīng)常性任務(wù)。在公共規(guī)制的運(yùn)行過程中,形式理性是保證其體系化、規(guī)范化的重要因素,也是保證公共規(guī)制能否向社會(huì)公眾提供普遍性、可預(yù)期性、明確性的社會(huì)規(guī)范的關(guān)鍵方法。但公共規(guī)制作用對(duì)象的多變性和不確定性以及實(shí)施中的時(shí)機(jī)、工具、手段和方式等諸多要素的不確定性,使得其難以實(shí)現(xiàn)嚴(yán)格的形式化要求,否則會(huì)導(dǎo)致適用中的僵化和不公。因此,公共規(guī)制既要通過構(gòu)造其概念體系、規(guī)則體系和程序制度來實(shí)現(xiàn)形式化品格,也要注重運(yùn)行中的結(jié)果因素和實(shí)質(zhì)推理,不應(yīng)完全回避政治、經(jīng)濟(jì)、倫理、習(xí)俗、宗教等法外因素。唯有此,才能優(yōu)化公共規(guī)制的運(yùn)行框架,提高公共規(guī)制的規(guī)范性和適應(yīng)性,并保證公共規(guī)制目標(biāo)的精準(zhǔn)實(shí)現(xiàn)。
[Abstract]:Under the condition of modern market economy, the government is widely involved in the market field by the way of public regulation to overcome all kinds of distortions and injustices caused by the spontaneous operation of the market, which has become a regular task of the governments of various countries. Formal rationality is not only an important factor to ensure its systematization and standardization, but also to ensure that public regulation can provide universality and predictability to the public. But the variability and uncertainty of the object of public regulation, as well as the uncertainty of the timing, tools, means and ways of implementation, make it difficult to realize the strict formal requirements. Otherwise, it will lead to fossilization and injustice in application. Therefore, public regulation should not only realize its formal character by constructing its concept system, rule system and procedure system, but also pay attention to the result factors and substantive reasoning in operation. Only in this way can we optimize the operational framework of public regulation, improve the standardization and adaptability of public regulation, and ensure the precise realization of the goal of public regulation.
