【摘要】：發(fā)展權概念的核心在于發(fā)展機會的均等,強調不同地區(qū)的當代和后代主體之間在政治、經濟、社會和文化領域的平等發(fā)展機會,發(fā)展權的保障有賴于符合公平正義訴求的經濟及社會發(fā)展政策。無論從理論發(fā)展的需要而言,還是從調節(jié)社會矛盾的現實需求出發(fā),都應進行促進發(fā)展權保障的公共政策路徑研究。本文認為公共政策應當在出發(fā)點、根本價值取向和優(yōu)先性等關鍵環(huán)節(jié)貫穿人的平等發(fā)展訴求,促進社會公平正義的實現。應當使公民擁有公共政策程序的有序參與機會,通過公平的分配政策平等享有物質財富與社會資源,并依托優(yōu)先保護資源環(huán)境的政策,使當代人與后代人都能夠享有優(yōu)質的自然環(huán)境。本文提出符合程序公正、結果公平、環(huán)保優(yōu)先和代際正義要求的路徑選擇思路,可為公共政策的制定、調整和優(yōu)化提供參考。
[Abstract]:At the heart of the concept of the right to development lies in the equality of opportunities for development, emphasizing equal opportunities for development in the political, economic, social and cultural fields between contemporary and future generations in different regions, The guarantee of the right to development depends on economic and social development policies that meet the demands of equity and justice. This paper holds that public policy should be based on the starting point, the basic value orientation and the priority, and so on. To promote the realization of social equity and justice... citizens should be given an orderly opportunity to participate in public policy procedures, equal access to material wealth and social resources through equitable distribution policies, and reliance on policies that give priority to the protection of the resource environment, This paper puts forward the path choice thought which accords with the procedure justice, the result fairness, the environmental protection priority and the intergenerational justice request, may provide the reference for the public policy formulation, adjustment and optimization.
