【摘要】:由于國際工程中復(fù)雜的政治、經(jīng)濟(jì)、工藝以及材料等風(fēng)險(xiǎn)情況特殊性,合同內(nèi)或者合同外等的原因都可能對(duì)承包商的形成工期影響,造成經(jīng)濟(jì)損失。實(shí)際索賠過程中,絕大多數(shù)工程以相應(yīng)法律和國際通用的合同標(biāo)準(zhǔn)條款規(guī)定以及相應(yīng)的程序、證據(jù),作為工程索賠的依據(jù)。進(jìn)度管理作為項(xiàng)目管理中的一環(huán),系統(tǒng)性地將工程中所涉及的事件都有機(jī)地結(jié)合到一起,并以邏輯關(guān)系相連,構(gòu)成關(guān)鍵線路及非關(guān)鍵線路組成的管理體系,應(yīng)用于整個(gè)工程中。在索賠事件的發(fā)生時(shí),追溯進(jìn)度管理過程中的關(guān)聯(lián)性,有助于提高索賠機(jī)會(huì)的成立,并且提供一系列工期及費(fèi)用索賠所需的有效支持資料。本文針對(duì)國際工程進(jìn)度管理思路,用以解決索賠問題。主要成果包括:(1)確定索賠的法律基礎(chǔ)及合同模式;(2)利用進(jìn)度管理中的界面管理,確定合同各方權(quán)責(zé),在工作分解的建立中,明確索賠的內(nèi)容,并在歸集資料時(shí)建立標(biāo)準(zhǔn)系統(tǒng);(3)利用進(jìn)度編制的雙邏輯模式,盡可能的使受影響的重大分項(xiàng)落在項(xiàng)目關(guān)鍵線路上,并利用進(jìn)度資料的準(zhǔn)備和確認(rèn)方式,在索賠之前或者索賠的前期,提供有效資料,提高索賠的成立成功率和索賠資料的準(zhǔn)確性。
[Abstract]:Due to the particularity of the complex political, economic, technological and material risk situations in international engineering, the reasons within or outside the contract may affect the contractor's duration of formation. In the actual claim process, the vast majority of the works are based on the terms of the relevant laws and international contract standards, as well as the corresponding procedures, evidence. As the basis of project claim, schedule management, as a link in project management, systematically combines the events involved in the project and links them with logic relations. The management system composed of critical and non-critical lines is applied to the whole project. When the claim event occurs, the correlation in the process of retroactive progress management is helpful to improve the establishment of the claim opportunity. And provide a series of time and cost claims for effective support information. This paper aims at the international project schedule management ideas. The main results include the determination of the legal basis and the contract model of the claim; 2) make use of the interface management in schedule management to determine the rights and responsibilities of the parties to the contract, make clear the content of the claim in the establishment of the work decomposition, and set up the standard system when collecting the data; Make use of the double logical model of schedule compilation, to the extent possible, make the major sub-items affected fall on the key lines of the project, and use the preparation and confirmation of progress information before or prior to the claim. Provide effective information to improve the success rate of claim and the accuracy of claim information.
