【摘要】：20世紀50年代,蘇聯(lián)民法范式全面植入中國法,從而使中國民事立法、民法理論和民事法律制度走上了全面移植蘇聯(lián)法之路。但正如立法和法律與作為其基礎的政治、經(jīng)濟、社會、文化等處于互動狀態(tài)一樣,中國民事主體制度對蘇聯(lián)法的移植也是建立在一定的內(nèi)生與外生基礎之上的。應該說,與中國傳統(tǒng)法在廢與立傳承上的斷裂迫使中國民事主體制度走上法律移植之路,而政治信仰與法律觀的高度趨同、計劃經(jīng)濟的體制同構、市民社會的基礎缺失以及專制主義的文化同質(zhì)等因素,則共同促成了中國民事主體制度對蘇聯(lián)法的全面移植。但是,在歷史基礎已然改變的情勢下,我國現(xiàn)行民事主體制度中仍然殘留的諸多蘇聯(lián)法痕跡卻是值得我們深思的。
[Abstract]:In 1950s, the Soviet civil law paradigm was fully implanted into Chinese law, thus making Chinese civil legislation. The theory of civil law and civil law system have taken the road of transplanting Soviet law completely, but just as legislation and law are interacted with the politics, economy, society and culture which are its basis. The transplant of Chinese civil subject system to Soviet law is also based on certain endogenous and exogenous basis. The break with the Chinese traditional law in the abolition and inheritance of the civil subject system forced China to go on the road of legal transplantation, and the political belief and legal concept of the highly convergent, the planned economy system isomorphism. The lack of the foundation of civil society and the cultural homogeneity of autocracy have contributed to the comprehensive transplantation of the Chinese civil subject system to the Soviet law. However, the historical basis has changed. Many traces of Soviet law still remain in the current civil subject system of our country.
