我國(guó)信托業(yè)監(jiān)管改革法律問(wèn)題研究

【摘要】:信托業(yè)是四大金融產(chǎn)業(yè)之一,對(duì)信托業(yè)的監(jiān)管是金融監(jiān)管中重要的組成部分。國(guó)家“十二五”規(guī)劃提出,我國(guó)在“十二五”規(guī)劃期間,要深化金融體制改革,努力完善金融監(jiān)管體制機(jī)制,并加強(qiáng)金融監(jiān)管之間的協(xié)調(diào)。黨的“十八大”報(bào)告再次重申了深化金融體制改革是未來(lái)我國(guó)經(jīng)濟(jì)體制改革的重要部分。本文以金融監(jiān)管改革為主題,重點(diǎn)研究了信托業(yè)監(jiān)管改革的法律問(wèn)題。本文針對(duì)我國(guó)信托業(yè)監(jiān)管目前所存在的問(wèn)題,提出了一些改革建議,,以期促進(jìn)信托業(yè)監(jiān)管體制的完善。 本文共分四章內(nèi)容。第一章介紹了我國(guó)信托業(yè)監(jiān)管的改革路徑。首先對(duì)信托業(yè)的三種不同解釋進(jìn)行了闡述,并最終選取了第三種解釋?zhuān)葱磐袠I(yè)包括了所有信托機(jī)構(gòu)和所有信托業(yè)務(wù)。從這個(gè)定義出發(fā),本章回顧并分析了1978年以來(lái)我國(guó)信托業(yè)監(jiān)管改革的歷史路徑。第二章分析了我國(guó)現(xiàn)行監(jiān)管中存在的問(wèn)題。我國(guó)信托業(yè)監(jiān)管中目前主要存在以下四個(gè)問(wèn)題:監(jiān)管主體偏多、監(jiān)管規(guī)則不統(tǒng)一、監(jiān)管內(nèi)容不全面、行業(yè)自律監(jiān)管有待加強(qiáng)。第三章闡述了我國(guó)信托業(yè)監(jiān)管改革的目標(biāo)、原則和模式。本章建議確立三個(gè)監(jiān)管改革目標(biāo):保護(hù)投資者(包括委托人和受益人)的合法權(quán)益、促進(jìn)信托業(yè)的公平競(jìng)爭(zhēng)和效益提高、提高對(duì)信托業(yè)監(jiān)管的效率。同時(shí),提出確立四個(gè)監(jiān)管改革原則:依法、適度、公開(kāi)、公正原則。本章還提出將機(jī)構(gòu)監(jiān)管模式改為功能監(jiān)管模式。第四章提出解決信托業(yè)監(jiān)管中存在問(wèn)題的建議。為了解決信托業(yè)監(jiān)管中存在的問(wèn)題,需要統(tǒng)一信托業(yè)監(jiān)管權(quán),制定統(tǒng)一高位階的監(jiān)管規(guī)則——《信托業(yè)法》,分步解決信托業(yè)監(jiān)管機(jī)構(gòu)問(wèn)題,在《信托業(yè)法》中規(guī)定適度全面的監(jiān)管內(nèi)容,并加強(qiáng)信托業(yè)行業(yè)自律監(jiān)管。
[Abstract]:Trust industry is one of the four major financial industries, the supervision of trust industry is an important part of financial supervision. During the period of the 12th five-year Plan, China should deepen the reform of the financial system, make great efforts to improve the mechanism of the financial supervision system, and strengthen the coordination between the financial supervision and control. The report of the 18th National Congress of the CPC reiterated that deepening the reform of the financial system is an important part of the economic system reform of our country in the future. This paper focuses on the reform of financial supervision and focuses on the legal issues of the reform of trust industry supervision. In view of the problems existing in the supervision of the trust industry in China, this paper puts forward some reform proposals in order to promote the perfection of the supervision system of the trust industry. This paper is divided into four chapters. The first chapter introduces the reform path of trust industry supervision in our country. Firstly, three different interpretations of trust industry are expounded, and finally the third one is selected, that is, trust industry includes all trust institutions and all trust operations. From this definition, this chapter reviews and analyzes the historical path of China's trust industry regulatory reform since 1978. The second chapter analyzes the existing problems in China's current supervision. At present, there are four main problems in the supervision of trust industry in China: the main body of supervision is too many, the regulation rules are not uniform, the content of supervision is not comprehensive, and the self-regulation of industry needs to be strengthened. The third chapter expounds the goal, principle and mode of China's trust industry supervision reform. This chapter proposes to establish three objectives of regulatory reform: to protect the legitimate rights and interests of investors (including clients and beneficiaries), to promote fair competition and improve the efficiency of trust industry supervision. At the same time, put forward to establish four principles of regulatory reform: the principle of law, moderation, openness, justice. This chapter also proposes to change the institutional regulatory model into a functional regulatory model. The fourth chapter puts forward some suggestions to solve the problems existing in the supervision of trust industry. In order to solve the problems existing in the supervision of the trust industry, it is necessary to unify the supervision power of the trust industry, formulate a unified high-level regulatory rule-the Trust Industry Law, and solve the problem of the trust industry supervision agency step by step. The Trust Law provides appropriate and comprehensive regulatory content and strengthens the self-regulation of the trust industry.
