【摘要】：現(xiàn)行審計(jì)法律規(guī)范體系不夠嚴(yán)密是導(dǎo)致國(guó)家審計(jì)決定書(shū)運(yùn)行障礙的根本原因。關(guān)于國(guó)家建設(shè)項(xiàng)目審計(jì)決定書(shū)法律效力的分歧主要有:審計(jì)機(jī)關(guān)是否有權(quán)對(duì)國(guó)家建設(shè)項(xiàng)目的施工方進(jìn)行審計(jì);審計(jì)機(jī)關(guān)是否有權(quán)對(duì)被審計(jì)相關(guān)合同的有效性作出判斷;審計(jì)決定書(shū)能否作為確定被審計(jì)項(xiàng)目合同價(jià)格的依據(jù);施工方對(duì)審計(jì)決定書(shū)的異議應(yīng)作為民事糾紛還是行政爭(zhēng)議處理等。我們應(yīng)借鑒國(guó)外相關(guān)審計(jì)法律,從以下幾方面完善我國(guó)的審計(jì)法律法規(guī)體系以強(qiáng)化國(guó)家建設(shè)項(xiàng)目審計(jì)決定書(shū)的法律效力:引入合同鑒證制度或者事前審計(jì)制度、強(qiáng)化強(qiáng)制審計(jì)制度、完善經(jīng)濟(jì)責(zé)任追究制度等。
[Abstract]:The current audit legal standard system is not strict is the basic reason that causes the state audit decision to run the obstacle.The differences on the legal effect of the audit decision of the national construction project are as follows: whether the audit institution has the right to audit the construction party of the national construction project, whether the audit institution has the right to judge the validity of the relevant contract to be audited;Whether the audit decision can be used as the basis for determining the contract price of the audited project, and whether the constructor's objection to the audit decision should be treated as civil dispute or administrative dispute, etc.We should draw lessons from foreign relevant audit laws, perfect our country's audit laws and regulations system from the following aspects to strengthen the legal effect of our country's construction project audit decision: introducing contract authentication system or prior audit system,Strengthen the system of compulsory audit and perfect the system of investigating economic responsibility.
