21世紀(jì)是能源的世紀(jì),能源問題是關(guān)乎一個國家的安全與發(fā)展的重要問題。當(dāng)前,隨著經(jīng)濟全球化的廣泛發(fā)展,國際能源合作的廣度和深度都不斷擴展,國際能源合作出現(xiàn)了一些新的形式,主要有貿(mào)易式合作、協(xié)議式合作以及投資式合作。為了進一步促進國際合作的發(fā)展,在全球以及區(qū)域范圍內(nèi)也涌現(xiàn)出一些能源合作的法律機制,全球性能源組織的國際法律機制,例如國際能源署、石油輸出國組織、能源憲章組織、國際能源論壇等;區(qū)域性的能源國際法律機制包括歐盟的國際能源法律機制、上海合作組織能源合作機制等等。對金磚國家來說,金磚國家作為新興國家崛起的代表,能源資源各具特色,能源發(fā)展需求極為相似,具備較好的合作基礎(chǔ)。此外,能源合作正逐漸成為金磚各國合作的一個主要內(nèi)容,構(gòu)建能源合作的法律機制也成為部分金磚國家的訴求。因此,隨著金磚國家能源合作的深入合作的內(nèi)容也將會發(fā)生深刻的變化。要保證金磚國l家能源合作能夠有序規(guī)范運行,就有必要借鑒國際能源合作法律機制形成之經(jīng)驗,構(gòu)建符合金磚國家能源特點和要求的能源合作法律機制框架,從制度上保障金磚國家能源合作的進一步發(fā)展。本文采取案例研究的方式,對五個主要的國際和區(qū)域能源合作的法律機制進行研究,包括...
