【摘要】：本文以安徽省征地制度改革為研究對(duì)象,以國(guó)內(nèi)外研究動(dòng)態(tài)為基礎(chǔ),通過(guò)對(duì)我國(guó)其他省份征地制度改革的典型做法的分析與借鑒,探討安徽省在土地征收制度現(xiàn)狀和改革方面存在的問(wèn)題以及未來(lái)的改革方向和途徑。首先本文在實(shí)地調(diào)研和收集資料的基礎(chǔ)上分析安徽省及其以外的省市征地制度現(xiàn)狀。調(diào)研中,通過(guò)問(wèn)卷調(diào)查、訪談和座談會(huì)的形式對(duì)征地補(bǔ)償標(biāo)準(zhǔn)、征地相關(guān)政策、征地程序以及農(nóng)民權(quán)益保障等情況進(jìn)行深入的了解。其次對(duì)調(diào)研區(qū)的征地制度現(xiàn)狀進(jìn)行重點(diǎn)分析和評(píng)述,雖然目前全國(guó)各地的征地工作主要是按照用地審批、“兩公告一登記”、征地批后實(shí)施監(jiān)管情況及群眾補(bǔ)償安置的順序進(jìn)行的,但是在征地程序中仍然存在一些缺陷,如制度方面、政策方面、經(jīng)濟(jì)方面、社會(huì)方面的缺陷,這些方面的缺陷造成了對(duì)被征地農(nóng)民的補(bǔ)償安置不到位,這并不能有效保障征地工作的順利進(jìn)行以及社會(huì)的穩(wěn)定發(fā)展,無(wú)法維持農(nóng)民的長(zhǎng)遠(yuǎn)生計(jì)。因此本文借鑒了全國(guó)其他省份在土地征收制度改革方面的經(jīng)驗(yàn)做法,通過(guò)對(duì)土地征收程序的規(guī)范以及對(duì)被征地農(nóng)民合法權(quán)益的維護(hù)方面的主要途徑進(jìn)行探討和研究,提出了安徽省征地制度改革的方向和路徑。最后本文在分析和探索調(diào)研區(qū)域典型做法的基礎(chǔ)上,根據(jù)黨的十八屆三中全會(huì)精神,確定安徽省征地制度改革的方向,并提出了改革的路徑,其中包括縮小征地范圍、土地確權(quán)登記發(fā)證、提高征地補(bǔ)償費(fèi)用、探索差別化安置方式、完善征地糾紛行政復(fù)議制度等方面的內(nèi)容。這些改革措施的提出有利于保障安徽省征地制度改革的順利進(jìn)行和社會(huì)的穩(wěn)定發(fā)展,更有利于促進(jìn)新型城鎮(zhèn)化和工業(yè)化的發(fā)展。
[Abstract]:This paper takes the reform of land expropriation system in Anhui Province as the research object, based on the domestic and foreign research trends, through the analysis and reference to the typical practices of the land expropriation system reform in other provinces of China. This paper probes into the problems existing in the present situation and reform of land expropriation system in Anhui Province, as well as the direction and ways of reform in the future. Firstly, this paper analyzes the current situation of land expropriation system in Anhui Province and other provinces and cities on the basis of field investigation and data collection. In the research, through the form of questionnaire, interview and forum, the paper makes a deep understanding of the compensation standard of land requisition, the policy of land requisition, the procedure of land expropriation and the protection of farmers' rights and interests. Secondly, the current situation of the land requisition system in the research area is analyzed and commented emphatically. Although the current land requisition work in various parts of the country is mainly based on the examination and approval of land use, "two announcements and one registration," The order of supervision and compensation and resettlement after land requisition and grant is carried out, but there are still some defects in the land expropriation procedure, such as institutional, policy, economic, social, etc. The defects in these aspects have resulted in the lack of compensation and placement for the peasants who have been expropriated, which can not effectively guarantee the smooth progress of the land requisition and the stable development of the society, and can not maintain the long-term livelihood of the peasants. Therefore, this paper draws lessons from the experience of other provinces in the reform of land expropriation system, through the norms of land expropriation procedures as well as the main ways to safeguard the legitimate rights and interests of farmers who have been expropriated. This paper puts forward the direction and path of land expropriation system reform in Anhui Province. Finally, based on the analysis and exploration of the typical practices of the research area, according to the spirit of the third Plenary session of the 18th CPC Central Committee, this paper determines the direction of the reform of the land expropriation system in Anhui Province, and puts forward the path of the reform, including reducing the scope of land expropriation. The registration and issuance of the right to land, the increase of the cost of compensation for land requisition, the exploration of differential settlement, and the improvement of the administrative reconsideration system of land expropriation disputes, etc. These reform measures are helpful to ensure the smooth progress of land requisition system reform and the stable development of society in Anhui Province, and to promote the development of new urbanization and industrialization.
