【摘要】：論文首先辨析"公有"與"共有"、"公有制"與"股份制"、"合作經(jīng)濟(jì)"等概念的關(guān)系,并將其作為研究的起點(diǎn)和理論依據(jù)。為解決農(nóng)村集體土地所有權(quán)主體虛化的問(wèn)題,提出農(nóng)地改革新思維,主要包括將鄉(xiāng)鎮(zhèn)集體所有的土地國(guó)有化,村集體土地中的農(nóng)用土地落實(shí)"隊(duì)為基礎(chǔ)",實(shí)行農(nóng)地股份共有制。以股份形式將農(nóng)地產(chǎn)權(quán)份額化,讓農(nóng)民成為土地共有權(quán)的現(xiàn)實(shí)所有者。農(nóng)民耕種的農(nóng)用土地沒(méi)有私有化,也沒(méi)有國(guó)有化,而是均等公平的聯(lián)合共有,并由農(nóng)村土地股份合作社作為農(nóng)村集體土地產(chǎn)權(quán)主體。農(nóng)地股份共有制是集體經(jīng)濟(jì),也具有公有制經(jīng)濟(jì)的形式。農(nóng)地股份共有制不是傳統(tǒng)的承包權(quán)股份化,更有利于推動(dòng)"三權(quán)分置"。這也許是農(nóng)村土地制度改革的新道路。
[Abstract]:This paper first analyzes the relationship between the concepts of "public ownership" and "common ownership", "public ownership" and "shareholding system", "cooperative economy", and regards them as the starting point and theoretical basis of the study. The paper puts forward the new thinking of rural land reform, which mainly includes nationalizing the land owned by collectives of villages and towns, implementing the "team as the basis" of agricultural land in the village collective land, implementing the joint ownership system of agricultural land, and making the shares of farmland property rights into shares in the form of shares. Farmers are the real owners of land ownership. Farm land cultivated by farmers is not privatized or nationalized, but shared equally and fairly. As the main body of the rural collective land property right, the rural land shareholding cooperative is the collective economy and also has the form of the public ownership economy. The farmland shareholding system is not the traditional demutualization of the contract right. This may be a new way to reform the rural land system.
