【摘要】：2008年黨的十七屆三中全會(huì)做出的《中共中央關(guān)于推進(jìn)農(nóng)村改革發(fā)展若干重大問(wèn)題的決定》,開(kāi)始了新的土地制度改革。新一輪土地流轉(zhuǎn)由此開(kāi)始。新一輪土地流轉(zhuǎn)是在改革開(kāi)放以來(lái),第一輪第二輪土地制度改革的基礎(chǔ)上進(jìn)行的。土地流轉(zhuǎn)的目的是實(shí)現(xiàn)土地的規(guī)�；�(jīng)營(yíng),促進(jìn)農(nóng)業(yè)現(xiàn)代化發(fā)展,增加農(nóng)民收入。在土地流轉(zhuǎn)過(guò)程中,農(nóng)民利益實(shí)現(xiàn)得到了制度上的保障,這大大提高了農(nóng)民生產(chǎn)糧食的積極性。但在一定的范圍內(nèi),還有一些待完善的地方。本論文通過(guò)對(duì)三輪土地制度改革的進(jìn)程進(jìn)行理論上的梳理,加深了馬克思主義關(guān)于土地資源與農(nóng)民利益之間的關(guān)系問(wèn)題的探討,從而看到土地流轉(zhuǎn)過(guò)程中土地資源合理利用所帶來(lái)的新特點(diǎn)及取得的成就。然而,在土地流轉(zhuǎn)中不可避免得出現(xiàn)一些新問(wèn)題。即土地流轉(zhuǎn)中農(nóng)民利益實(shí)現(xiàn)面臨一些困境和問(wèn)題。為了進(jìn)一步解決土地流轉(zhuǎn)中實(shí)現(xiàn)農(nóng)民利益面臨的困境及問(wèn)題,本文通過(guò)原因分析,并在此基礎(chǔ)上提出解決對(duì)策。論文包括三部分,基本內(nèi)容如下:第一部分介紹了新一輪土地流轉(zhuǎn)的相關(guān)概況及實(shí)現(xiàn)農(nóng)民利益的理論依據(jù)。新一輪土地流轉(zhuǎn)是在第一輪、第二輪土地制度改革的基礎(chǔ)上,為了彌補(bǔ)家庭承包責(zé)任制不足的背景下產(chǎn)生的。新一輪土地流轉(zhuǎn)不僅實(shí)現(xiàn)了生產(chǎn)關(guān)系的調(diào)整,而且呈現(xiàn)出一些新特點(diǎn)。馬克思恩格斯的農(nóng)民利益思想是實(shí)現(xiàn)農(nóng)民利益的根本理論依據(jù)。第二部分分析了新一輪土地流轉(zhuǎn)時(shí)期農(nóng)民利益的現(xiàn)實(shí)狀況。新一輪的土地流轉(zhuǎn)實(shí)現(xiàn)了資源的有效利用,促進(jìn)了農(nóng)業(yè)現(xiàn)代化,加快了城市化步伐,增加了農(nóng)民收入。但由于土地流轉(zhuǎn)制度的不完善及土地流轉(zhuǎn)市場(chǎng)的不成熟,農(nóng)民利益實(shí)現(xiàn)還面臨一些困境。具體表現(xiàn)為土地流轉(zhuǎn)不規(guī)范;征地補(bǔ)償過(guò)低;農(nóng)民的生存發(fā)展權(quán)受損。第三部分提出新一輪土地流轉(zhuǎn)時(shí)期實(shí)現(xiàn)農(nóng)民利益的對(duì)策建議。政府及相關(guān)部門要在堅(jiān)持穩(wěn)定承包權(quán),放活使用權(quán)原則的基礎(chǔ)上,積極完善土地流轉(zhuǎn)的相關(guān)制度,培育和發(fā)展土地流轉(zhuǎn)市場(chǎng),實(shí)現(xiàn)農(nóng)民利益并使之最大化。
[Abstract]:In 2008, the third Plenary session of the 17 CPC Central Committee made the "CPC Central Committee on the promotion of rural reform and development of a number of major issues". A new reform of the land system began. A new round of land transfer began. The new round of land transfer is since the reform and opening up. The purpose of land circulation is to realize the large-scale management of land, to promote the development of agricultural modernization and to increase farmers' income. The realization of farmers' interests is guaranteed by the system, which greatly improves the enthusiasm of farmers to produce grain, but within a certain scope. There are still some areas to be improved. This paper through the three rounds of land system reform process of theoretical combing, deepen the Marxist discussion on the relationship between land resources and farmers' interests. Thus we can see the new characteristics and achievements brought by the rational use of land resources in the process of land circulation. In order to solve the difficulties and problems of realizing the interests of farmers in the land circulation, some new problems will inevitably arise, that is, the difficulties and problems in the realization of the interests of farmers in the land circulation. This paper through the cause analysis, and on this basis proposes the solution countermeasure. The thesis includes three parts. The basic contents are as follows: the first part introduces the general situation of the new round of land circulation and the theoretical basis for realizing the interests of farmers. The new round of land circulation is based on the first round and the second round of land system reform. In order to make up for the lack of household contract responsibility system under the background of the new round of land transfer not only to achieve the adjustment of production relations. Marx and Engels' thought of farmers' interests is the fundamental theoretical basis for realizing peasants' interests. The second part analyzes the present situation of farmers' interests during the new round of land circulation. Land circulation realizes the effective utilization of resources. Promote agricultural modernization, accelerate the pace of urbanization, increase the income of farmers, but due to the imperfect land transfer system and the immature land transfer market. The realization of farmers' interests also faces some difficulties. The compensation for land expropriation is too low; The third part put forward a new round of land transfer period to realize the interests of farmers. The government and relevant departments should adhere to the principle of stable contracting rights and the principle of activating the right to use. Actively improve the land transfer system, cultivate and develop the land transfer market, realize and maximize the interests of farmers.
