【摘要】:土地資源指的是現階段已經得到充分開發(fā)利用以及在以后具有規(guī)劃與使用潛力的土地。土地資源不僅對國家政治穩(wěn)定發(fā)展以及經濟平穩(wěn)運行至關重要;同時也是我國在制定土地管理政策以及法律制度的重要依據來源。在我國土地資源結構體系中,農村建設用地為我國農村當地社會經濟快速發(fā)展提供重要物質條件。尤其在我國實行改革開放制度以后,農村地區(qū)經濟發(fā)展不斷取得突出成績,農民生活水平與質量不斷得到提升。由于我國城市化快速發(fā)展所導致的城市人口激增、社會產業(yè)結構聚集發(fā)展,引發(fā)對農村建設用地以及其他類型土地資源的需求也不斷快速增長,導致我國廣大農村地區(qū)對建設用地實際需求總量不斷增加,與我國現階段所提供的建設用地總體規(guī)模矛盾不斷摩擦升級。農村的發(fā)展與穩(wěn)定是我國進行政治體制改革以及國民經濟穩(wěn)步發(fā)展的重要條件,通過對我國當前農村建設用地調控體系的研究并指出其中不足,對于以后農村地區(qū)有效使用建設用地、控制農地建設用地規(guī)模盲目擴張、完善農村地區(qū)發(fā)展與建設具有積極促進作用。通過對我國農村建設用地利用現狀以及我國現行農村建設用地體系的研究,以我國農村建設用地政策建設、法律制度調整為切入點,并與農村建設用地發(fā)展實際相結合,從而構建出一套完整、有效的新型調控體系,以進一步完善我國農村地區(qū)對于建設用地的結構形式,提高土地資源利用效率,對于保障我國農村經濟穩(wěn)定以及建設用地資源合理開發(fā)利用具有重要作用。本研究采用了文獻資料、實證研究、典型調查、規(guī)范與實證相結合等研究方法,以土地稀缺理論、制度變遷理論、政府尋租理論、生態(tài)經濟學理論等為理論指導,并結合管理學等多門學科研究方法,將我國當前農村發(fā)展客觀實際以及建設用地開發(fā)利用等情況作為研究基礎,理清農村建設用地合理利用與宏觀經濟發(fā)展、法律建設以及我國農村建設用地基本原理的關系,即農村建設用地的合理調控需要以國家具體土地政策為基礎,以法律規(guī)定為基準,結合農村當地實際情況進行調控布局與改進。通過優(yōu)化農村建設用地資源供應調控、農村建設用地政策法律完善化、規(guī)范化調控以及農村建設用地資源保護機制為優(yōu)化路徑,以實現協調區(qū)域發(fā)展,調整和優(yōu)化農村建設用地結構,保證農村建設用地合理規(guī)劃與使用,促進農村地區(qū)穩(wěn)定發(fā)展。
[Abstract]:Land resources refer to the land which has been fully developed and utilized at the present stage and has the potential to plan and use in the future. Land resources are not only of great importance to the stable development of national politics and economy, but also to the smooth operation of economy. At the same time, it is also the important source of our country's land management policy and legal system. Rural construction land provides important material conditions for the rapid development of rural local economy, especially after the implementation of the reform and opening up system, rural economic development has made outstanding achievements. Due to the rapid development of urbanization in China, the urban population has increased rapidly, and the social industrial structure has gathered and developed. The demand for rural construction land and other types of land resources is also growing rapidly, which leads to the increase of the actual demand for construction land in the vast rural areas of China. The contradiction with the overall scale of the construction land provided by our country at present is constantly frictional and upgraded. The development and stability of the countryside is an important condition for the political system reform and the steady development of the national economy in our country. Through the study of the current control system of rural construction land in our country and points out the shortcomings, for the future effective use of construction land in rural areas, control the scale of farmland construction land expansion blindly. Improving the development and construction of rural areas plays an active role in promoting. Through the study of the current situation of rural construction land use and the current system of rural construction land in China, the policy construction of rural construction land in China. The adjustment of legal system is the starting point and combines with the actual development of rural construction land, so as to construct a set of complete and effective new regulation and control system. In order to further improve the structural form of construction land in rural areas of China, improve the efficiency of land use. In order to ensure the stability of rural economy and the rational development and utilization of construction land resources, this study adopts the methods of literature, empirical research, typical investigation, standardization and empirical combination. Land scarcity theory, institutional change theory, government rent-seeking theory, ecological economics theory as the theoretical guidance, and combined with management and other multi-disciplinary research methods. The objective reality of rural development and the development and utilization of construction land in China are taken as the research basis to clarify the rational use of rural construction land and macroeconomic development. The relationship between legal construction and the basic principle of rural construction land in China, that is, the rational regulation and control of rural construction land needs to be based on the specific land policy of the country, and on the basis of legal provisions. According to the actual situation in rural areas, the regulation layout and improvement. Through the optimization of rural construction land resources supply control, the rural construction land policy law is perfect. Standardized regulation and rural construction land resources protection mechanism for the optimization of the path to achieve coordinated regional development, adjust and optimize the structure of rural construction land to ensure the rational planning and use of rural construction land. We will promote stable development in rural areas.
