【摘要】：土地是農(nóng)業(yè)生產(chǎn)最基本和不可替代的生產(chǎn)資料,是農(nóng)民維持生計的基本保障,也是人類社會賴以生存與發(fā)展不可或缺的物質(zhì)基礎(chǔ)。然而,在我國特有的城鄉(xiāng)二元土地產(chǎn)權(quán)結(jié)構(gòu)下,農(nóng)民的土地權(quán)益并沒有得到有效的保障,土地權(quán)益缺失成為不可爭辯的事實。土地權(quán)益是農(nóng)民所有權(quán)益中最根本的權(quán)益,建立農(nóng)民土地權(quán)益有效保障機制,解決農(nóng)民土地權(quán)益受損問題,不僅是社會經(jīng)濟發(fā)展必然要求,也是全面建設(shè)小康社會的戰(zhàn)略需求。本文認為,農(nóng)民土地權(quán)益缺失的根本原因在于城鄉(xiāng)二元結(jié)構(gòu)下的農(nóng)村土地制度缺陷。切實保障農(nóng)民土地權(quán)益,不僅有利于鞏固農(nóng)民在土地經(jīng)營中的地位、拉動內(nèi)需、穩(wěn)定農(nóng)業(yè)產(chǎn)出進而保障糧食安全,同時也是社會公正的客觀要求。筆者在對新中國成立以來我國土地制度變遷與農(nóng)民土地權(quán)益進行歷史性梳理中得出,不管是在農(nóng)地征收還是農(nóng)地使用權(quán)流轉(zhuǎn)過程中,農(nóng)民土地權(quán)益都嚴重缺失。權(quán)益缺失的根本原因在于,現(xiàn)行農(nóng)地制度下存在土地集體所有制產(chǎn)權(quán)安排不科學、農(nóng)地征收制度不合理、集體土地征收程序不規(guī)范、土地使用權(quán)流轉(zhuǎn)制度不合理等制度性缺陷。切實保障農(nóng)民土地權(quán)益,要從改革現(xiàn)有農(nóng)村集體土地所有權(quán)、土地征收、農(nóng)村土地流轉(zhuǎn)和深化改革農(nóng)村土地管理等相關(guān)制度入手,在立足于現(xiàn)行基本農(nóng)地制度條件下,走長期的、改革的、新農(nóng)村建設(shè)的道路,破除“城鄉(xiāng)二元土地產(chǎn)權(quán)結(jié)構(gòu)”給農(nóng)民土地權(quán)益帶來的損害。在未來的土地制度變遷中,必須明確、公正的體現(xiàn)農(nóng)民的土地權(quán)益,讓農(nóng)民公平的分享現(xiàn)代化成果,使農(nóng)村繼續(xù)成為推進工業(yè)化和城鎮(zhèn)化的中堅力量。
[Abstract]:Land is the most basic and irreplaceable means of production in agricultural production. It is the basic guarantee for farmers to maintain their livelihood, and it is also an indispensable material basis for the survival and development of human society. Under the unique urban-rural dual structure of land property rights, farmers' land rights and interests have not been effectively protected. The lack of land rights and interests has become an indisputable fact. Land rights and interests are the most fundamental rights and interests of all farmers, to establish an effective protection mechanism for farmers' land rights and interests, to solve the problem of damage to farmers' land rights and interests. It is not only the inevitable requirement of social and economic development, but also the strategic demand of building a well-off society in an all-round way. The fundamental reason for the loss of farmers' land rights and interests lies in the defects of the rural land system under the dual structure of urban and rural areas. Effectively protecting the farmers' land rights and interests is not only conducive to consolidating the position of farmers in land management and stimulating domestic demand. It is also an objective requirement of social justice to stabilize agricultural output and ensure food security. The author has made a historical analysis of the land system changes and farmers' land rights and interests since the founding of New China. Whether in the process of farmland expropriation or land use right transfer, farmers' land rights and interests are seriously missing. The fundamental reason for the lack of rights and interests lies in the unscientific arrangement of land collective ownership property rights under the current agricultural land system. The system of agricultural land expropriation is unreasonable, the procedure of collective land expropriation is not standardized, the system of land use right is unreasonable, and so on. To ensure the farmers' land rights and interests, we should reform the existing rural collective land ownership. Land expropriation, rural land circulation and deepening the reform of rural land management and other related systems, based on the current basic farmland system conditions, take a long-term, reform, new rural construction road. In the future, it is necessary to clearly and fairly reflect the farmers' land rights and interests in the future land system changes. Let farmers share the fruits of modernization equitably, so that rural areas will continue to be the backbone of industrialization and urbanization.
