【摘要】：隨著我國經(jīng)濟全球化步伐的加快,以及各個國家對技術創(chuàng)新重要性的深刻認識,技術專利保護正在逐漸納入我國企業(yè)建設的重要因素,更是我國產(chǎn)業(yè)整體水平提升,實現(xiàn)走出國門戰(zhàn)略方針的核心力量。近幾年,各國企業(yè)紛紛著手企業(yè)自身的專利規(guī)劃布局,建立企業(yè)的專利戰(zhàn)略,依靠專利維護自身技術保護權益,構建相關專利屏障,為企業(yè)技術優(yōu)勢提供保障。全球能源枯竭與環(huán)境污染等問題表現(xiàn)的日趨強烈,發(fā)展新能源汽車是我國乃至全世界實現(xiàn)節(jié)能減排工作的重中之重。與國外一些知名企業(yè)比較,我國在新能源汽車驅動技術與動力電池材料技術方面相對落后,在專利戰(zhàn)略構建規(guī)劃方面相距甚遠。本文希望在對國外新能源汽車企業(yè)典型案例的解讀過程中,發(fā)現(xiàn)我國相關企業(yè)在專利戰(zhàn)略構建方面的不足,并制定相應的解決措施。本文簡述了專利的發(fā)展歷史、專利分類,從而引出專利戰(zhàn)略對企業(yè)發(fā)展的重要作用。本文并在第三章通過對我國新能源汽車專利申請量、專利權人、發(fā)明人及專利分類進行數(shù)據(jù)統(tǒng)計,進而得出我國目前新能源汽車專利市場情況。本文第四章主要通過對特斯拉及豐田對自身電動汽車及燃料電池汽車技術專利開放的戰(zhàn)略案例,對IBM以及諾基亞等典型實施了專利戰(zhàn)略的企業(yè)進行案例敘述、分析,進一步使讀者認識到,制定一套行之有效的專利戰(zhàn)略規(guī)劃是企業(yè)謀求長遠壯大的必要手段。第五章筆者則依托第三章與第四章內容對我國新能源汽車技術專利分布、企業(yè)專利布局等調研的數(shù)據(jù),從而進行我國國家及企業(yè)現(xiàn)行專利實施規(guī)劃中的問題,并分別從設立專利網(wǎng)絡、專利交叉、使用權許可、專利的協(xié)同組合等多個方面對我國新能源汽車后期發(fā)展的專利布局提出相關實施建議。
[Abstract]:With China's accelerated pace of economic globalization, each country and a profound understanding of the importance of technological innovation, technology patent protection is gradually into the important factors of China's construction enterprises, is the overall level of China's industrial upgrading, realize the core strength abroad strategy. In recent years, national enterprises have started planning the layout of enterprise patent the establishment of enterprise patent strategy, patent rights protection technology rely on to maintain their own construction, relevant patent barrier to provide protection for the enterprise technology advantage. The global energy depletion and environmental pollution problems such as performance is strong. The development of new energy vehicles is the priority among priorities in China and the world to achieve energy-saving emission reduction work. With some famous foreign enterprises, our country in the new energy vehicles driving technology and battery materials technology is relatively backward, in the construction of patent strategy planning Is far. In this paper, the process of interpretation of foreign new energy automobile enterprise case, found that China's enterprises in the construction of patent strategy deficiencies, and formulate corresponding measures. This paper reviews the historical development, patent classification, which leads to an important role for the development of the enterprise patent strategy in this paper. In the third chapter on China's new energy automobile patent applications, patents, inventors and patent classification statistical data, and then draw the current China's new energy automobile patent market. The fourth chapter mainly through the strategic case on their own electric vehicles and fuel cell vehicles technology patent Tesla and TOYOTA. The IBM and NOKIA and other typical implementation of the patent strategy of enterprise case description, analysis, further enable the readers to know, to establish a set of effective patent strategy Planning is a necessary means for enterprise long-term growth. The fifth chapter is based on the third chapter and the fourth chapter on the new energy automotive technology patent distribution in our country, the enterprise patent layout research data, so as to carry out the planning problems in the implementation of China's national enterprises and existing patents, and separately from the establishment of patent, patent cross. Right to use license, a patent on the synergistic combination of new energy vehicles in the late development of China's patent layout puts forward related suggestions.
