【摘要】：隨著我國(guó)經(jīng)濟(jì)社會(huì)的發(fā)展和城鎮(zhèn)化進(jìn)程的不斷加快,生態(tài)環(huán)境遭到嚴(yán)重破壞,生態(tài)用地不斷被擠占。而為了加強(qiáng)宏觀管理,各部門、各行業(yè)制定了名目繁多的諸多規(guī)劃,但在確定的同一國(guó)土空間內(nèi),如何實(shí)現(xiàn)各部門、各行業(yè)之間的協(xié)調(diào),實(shí)現(xiàn)國(guó)土空間的合理利用,以達(dá)到生態(tài)環(huán)境保護(hù)的目的成為政府和學(xué)者研究的熱點(diǎn)。自2008年開始,廣州省開展了“多規(guī)合一”的試點(diǎn)工作,之后“多規(guī)合一”工作開始開展起來。從最初的“三規(guī)合一”(三規(guī)主要包括經(jīng)濟(jì)社會(huì)發(fā)展規(guī)劃、城鄉(xiāng)規(guī)劃和土地利用規(guī)劃)到后來加入生態(tài)環(huán)境保護(hù)規(guī)劃的“多規(guī)合一”,正是體現(xiàn)了經(jīng)濟(jì)社會(huì)發(fā)展中對(duì)環(huán)境保護(hù)的越來越重視。而且,生態(tài)環(huán)境本就應(yīng)該是一切發(fā)展的前提條件,離開生態(tài)環(huán)境任何發(fā)展都是空談。本文從環(huán)境保護(hù)的角度出發(fā),認(rèn)為“多規(guī)合一”工作應(yīng)該將環(huán)境保護(hù)納入考量,并對(duì)“多規(guī)合一”工作提出建議:首先,系統(tǒng)介紹了我國(guó)現(xiàn)行的規(guī)劃體系,以及“多規(guī)合一”的本質(zhì)和發(fā)展歷程,指出了“多規(guī)合一”的必要性、作用,以及在“多規(guī)合一”過程中出現(xiàn)的不考慮環(huán)境保護(hù)等方面的弊病。其次,具體分析了“多規(guī)合一”過程中面臨的諸多環(huán)境法律方面的問題。不僅是在規(guī)劃體系方面存在體系龐雜,多部門職權(quán)交叉、工作效率低下等問題;在具體的操作過程中存在著規(guī)劃期限、技術(shù)標(biāo)準(zhǔn)等問題;更是存在著生態(tài)理念基礎(chǔ)差的基礎(chǔ)性問題。最后,本文給出了相關(guān)的法律建議。建立和完善“多規(guī)合一”體系,編制我國(guó)綜合性的規(guī)劃法典,通過規(guī)劃法典的確定,進(jìn)一步對(duì)工作組織機(jī)構(gòu)、編制方法、邊界確定等具體方面進(jìn)行詳細(xì)的規(guī)定,以便在具體的規(guī)劃中做到有法可依,此外,還對(duì)“多規(guī)合一”工作的順利進(jìn)行,提出了保障性法律建議。
[Abstract]:With the development of economy and society and the acceleration of urbanization, the ecological environment has been seriously damaged and ecological land has been occupied. In order to strengthen macro management, various departments and industries have formulated various plans, but in the same land and space as determined, how to realize the coordination among various departments and industries, and how to realize the rational use of land and space, To achieve the purpose of ecological environmental protection has become the focus of the government and scholars. Since 2008, Guangzhou Province has carried out the pilot work of "multiple rules in one", and then the work of "multiple rules in one" began. From the original "three rules in one" (mainly including economic and social development planning, urban and rural planning and land use planning) to the later "multi-planning integration" of ecological environmental protection planning, It is reflected in the economic and social development of environmental protection more and more attention. Moreover, the ecological environment should be the precondition of all development, any development from the ecological environment is empty talk. From the point of view of environmental protection, this paper thinks that environmental protection should be taken into account in the work of "multi-planning in one", and puts forward some suggestions to the work of "multi-planning in one": first, it systematically introduces the current planning system of our country. As well as the essence and development course of "multiple rules in one", this paper points out the necessity and function of "multiple rules in one", as well as the disadvantages of not considering the environmental protection in the process of "multiple rules in one". Secondly, the paper analyzes many environmental legal problems in the process of "multi-regulation in one". Not only in the planning system, but also in the planning system, there are many problems, such as the system is complicated, the multi-department functions and powers are intersected, the work efficiency is low, and there are some problems in the concrete operation process, such as the planning time limit, the technical standard and so on. Even more, there is a basic problem of poor ecological concept. Finally, this paper gives the relevant legal advice. To establish and improve the system of "integration of multiple rules and regulations", to formulate a comprehensive planning code of our country, and to make further detailed provisions on the specific aspects of work organization, compilation methods, boundary determination, and so on, through the determination of the planning code. In order to make sure that there are laws to follow in the concrete plan, in addition, it also puts forward the safeguard legal suggestion to the smooth progress of the work of "multiple rules in one".
