【摘要】：本文是在中國(guó)電商的迅猛發(fā)展改變著傳統(tǒng)零售業(yè)格局這一宏觀背景下,基于近年來(lái)網(wǎng)絡(luò)零售業(yè)頻繁爆出假貨丑聞、由于缺乏有效監(jiān)管從而亂象叢生這一基本事實(shí)而展開(kāi)的。將公共治理理論作為研究基礎(chǔ),同時(shí)結(jié)合該理論在西方國(guó)家的應(yīng)用及對(duì)中國(guó)政府體制改革所產(chǎn)生的啟示意義,探討該理論在治理國(guó)內(nèi)網(wǎng)絡(luò)零售業(yè)問(wèn)題中可發(fā)揮的重要作用。文中結(jié)合國(guó)家統(tǒng)計(jì)局、商務(wù)部及權(quán)威媒體的相關(guān)數(shù)據(jù),對(duì)國(guó)內(nèi)零售業(yè)近年來(lái)整體現(xiàn)狀及未來(lái)發(fā)展趨勢(shì)做出總結(jié)：網(wǎng)絡(luò)零售業(yè)已成為導(dǎo)致國(guó)內(nèi)零售業(yè)格局變化的重要原因。而網(wǎng)絡(luò)交易規(guī)模增速明顯,移動(dòng)網(wǎng)購(gòu)成為發(fā)展趨勢(shì)不可阻擋,“互聯(lián)網(wǎng)+”正在從內(nèi)到外改變?nèi)藗兊纳罘绞�。結(jié)合消費(fèi)者的親身體驗(yàn),收集第一手資料,深入展現(xiàn)網(wǎng)絡(luò)零售業(yè)目前存在的幾大問(wèn)題如,售假成為網(wǎng)絡(luò)零售業(yè)的“頭號(hào)毒瘤”、交易對(duì)象認(rèn)定的模糊性、退貨困難、網(wǎng)上欺詐、售后服務(wù)問(wèn)題、行業(yè)缺乏有效的贏利模式影響可持續(xù)發(fā)展等。本文還將2015年“淘寶與國(guó)家工商總局之爭(zhēng)”作為典型事件,對(duì)事件帶來(lái)的影響,對(duì)其問(wèn)題產(chǎn)生的深層次原因進(jìn)行挖掘,反思執(zhí)法程序上存在的缺陷及事件折射出的政企關(guān)系變化,對(duì)政府在典型事件中的角色及發(fā)揮的作用進(jìn)行分析。通過(guò)對(duì)典型事件的調(diào)查分析和研究,明確有關(guān)問(wèn)題的性質(zhì),以便對(duì)癥下藥,有針對(duì)性的提出可操作性的對(duì)策與建議。最后通過(guò)對(duì)國(guó)內(nèi)外相關(guān)實(shí)施公共治理的策略的借鑒,結(jié)合公共治理理論及我國(guó)的現(xiàn)實(shí)國(guó)情提出針對(duì)我國(guó)網(wǎng)絡(luò)零售業(yè)存在的問(wèn)題的治理對(duì)策,從而得出結(jié)論：在網(wǎng)絡(luò)零售業(yè)問(wèn)題治理方面,首要任務(wù)是完善相關(guān)法律法規(guī),嚴(yán)格網(wǎng)絡(luò)營(yíng)運(yùn)商認(rèn)證制度及銷(xiāo)售商準(zhǔn)入制度,完善售后處理賠付機(jī)制和消費(fèi)者維權(quán)制度,進(jìn)一步強(qiáng)化網(wǎng)絡(luò)營(yíng)運(yùn)商的監(jiān)管責(zé)任,營(yíng)造良好環(huán)境,讓網(wǎng)絡(luò)零售業(yè)健康持續(xù)發(fā)展。同時(shí),消費(fèi)者則應(yīng)增強(qiáng)自我保護(hù)意識(shí)。
[Abstract]:Under the macro background that the rapid development of Chinese e-commerce is changing the pattern of traditional retailing, this paper is based on the fact that the online retailing industry frequently breaks out fake scandals in recent years, which is caused by the lack of effective supervision and chaos. This paper takes the theory of public governance as the research foundation, and discusses the important role that the theory can play in the management of the domestic network retailing in the light of its application in western countries and its enlightening significance to the reform of Chinese government system. Based on the relevant data of the National Bureau of Statistics, Ministry of Commerce and authoritative media, this paper summarizes the overall situation and future development trend of domestic retailing in recent years: Internet retailing has become an important reason for the change of domestic retailing pattern. While the scale of online transactions is increasing significantly, mobile online shopping has become an irresistible trend, "Internet" is changing people's way of life from inside to outside. Combining with the personal experience of consumers, collecting first-hand information and showing in depth several major problems existing in online retailing, such as: the sale of fake products has become the "number one cancer" of online retailing, the ambiguity of the identification of trading objects, the difficulty of returning goods, and online fraud, The problem of after-sales service, the lack of effective profit model affects sustainable development. This article also regards "the contention between Taobao and the State Administration of Industry and Commerce" as a typical event in 2015, and excavates the deep-seated causes of the problem. Reflecting on the defects in the law enforcement procedure and the changes of the relationship between the government and enterprises reflected by the incident, this paper analyzes the role of the government in the typical events and the role it plays. Through the investigation and analysis of the typical events, the nature of the related problems is clarified, so as to put forward some practical countermeasures and suggestions in order to find the right remedy for the case. Finally, through the reference of the domestic and foreign related implementation of public governance strategy, combined with the public governance theory and the reality of our country, put forward the countermeasures to solve the problems existing in the network retailing industry in our country. It is concluded that the most important task in the management of network retailing problems is to perfect the relevant laws and regulations, to strictly enforce the certification system of network operators and the entry system of vendors, to perfect the mechanism of compensation after sale and to protect the rights of consumers. Further strengthen the regulatory responsibility of network operators, create a good environment for the healthy and sustainable development of online retailing. At the same time, consumers should enhance their awareness of self-protection.
