中國(guó)對(duì)外勞務(wù)輸出人員人身安全風(fēng)險(xiǎn)研究

【摘要】:隨著我國(guó)改革開放走出去的步伐逐漸加快,越來越多的中國(guó)公民通過勞務(wù)輸出走出國(guó)門,到世界各地謀職工作,為家鄉(xiāng)帶回更多的資金以及境外的技術(shù),為社會(huì)帶來了良好的經(jīng)濟(jì)效益。21世紀(jì)以來,中國(guó)工人海外勞務(wù)風(fēng)險(xiǎn)案例頻發(fā),有的涉及人數(shù)眾多、影響廣泛,中國(guó)對(duì)外勞務(wù)輸出人員人身安全風(fēng)險(xiǎn)呈現(xiàn)多元化狀態(tài)。對(duì)外勞務(wù)風(fēng)險(xiǎn)頻發(fā),嚴(yán)重影響在外勞務(wù)人員人身安全,嚴(yán)重影響外派勞務(wù)企業(yè)和中介機(jī)構(gòu)企業(yè)經(jīng)營(yíng)效益,甚至影響國(guó)家之間的外交關(guān)系,影響國(guó)家利益。我們需要對(duì)對(duì)外勞務(wù)輸出人員人身安全風(fēng)險(xiǎn)進(jìn)行系統(tǒng)性分析,以幫助政府和企業(yè)以及個(gè)人提高防范與應(yīng)付風(fēng)險(xiǎn)能力。本文將對(duì)外勞務(wù)輸出人員人身安全風(fēng)險(xiǎn)劃分成來自環(huán)境的風(fēng)險(xiǎn)與來自勞務(wù)輸出方式的風(fēng)險(xiǎn),進(jìn)行系統(tǒng)性的研究,進(jìn)行風(fēng)險(xiǎn)識(shí)別和原因分析,并結(jié)合遭遇索馬里海盜的勞務(wù)人員獲救案例進(jìn)行風(fēng)險(xiǎn)研究,最后從避免風(fēng)險(xiǎn)、減弱風(fēng)險(xiǎn)、轉(zhuǎn)移風(fēng)險(xiǎn)、接受風(fēng)險(xiǎn)四方面考慮,提出應(yīng)對(duì)對(duì)外勞務(wù)輸出人員人身安全風(fēng)險(xiǎn)的相關(guān)對(duì)策建議。本文采取了文獻(xiàn)研究法、分類歸納法、數(shù)據(jù)分析方法、案例研究法對(duì)中國(guó)對(duì)外勞務(wù)輸出人員人身安全風(fēng)險(xiǎn)相關(guān)資料和數(shù)據(jù)進(jìn)行了梳理和分析。本文主要分為五個(gè)部分。第一部分是我國(guó)對(duì)外勞務(wù)輸出的發(fā)展歷程和發(fā)展現(xiàn)狀。第二部分是我國(guó)對(duì)外勞務(wù)輸出人員面對(duì)的人身安全風(fēng)險(xiǎn)分析,包括來自環(huán)境的風(fēng)險(xiǎn)和來自勞務(wù)輸出方式的風(fēng)險(xiǎn)。第三部分是我國(guó)對(duì)外勞務(wù)輸出人員人身安全風(fēng)險(xiǎn)原因分析。第四部分是我國(guó)船員遭遇索馬里海盜案例。最后一部分是提出了應(yīng)對(duì)我國(guó)對(duì)外勞務(wù)輸出人員人身安全風(fēng)險(xiǎn)的相關(guān)避免風(fēng)險(xiǎn)對(duì)策、減弱風(fēng)險(xiǎn)對(duì)策、轉(zhuǎn)移風(fēng)險(xiǎn)對(duì)策和接受風(fēng)險(xiǎn)對(duì)策,如利用政府資源、利用合同條款、利用信用保險(xiǎn)等?茖W(xué)的對(duì)策幫助中國(guó)對(duì)外勞務(wù)合作企業(yè)和勞務(wù)輸出中介以及勞務(wù)個(gè)人更好的應(yīng)對(duì)人身安全風(fēng)險(xiǎn)。
[Abstract]:As the pace of China's reform and opening up to the outside world has gradually accelerated, more and more Chinese citizens are going abroad through labor export to seek jobs around the world, bringing home more funds and foreign technology. Has brought good economic benefits to the society since the 21st century, Chinese workers overseas labor risk cases occur frequently, some involving a large number of people, a wide range of impact, The personal security risks of China's foreign labor export personnel are diversified. The frequent occurrence of foreign labor services risks seriously affects the personal safety of foreign labor service personnel and seriously affects the operating efficiency of overseas labor service enterprises and intermediary enterprises. It even affects the diplomatic relations between countries and affects the national interests. We need to make a systematic analysis of the personal security risks of personnel exporting foreign labor services. In order to help the government, enterprises and individuals to improve their ability to prevent and cope with risks, this paper divides the personal safety risks of foreign labor export personnel into the risks from the environment and the risks from the mode of labor export, and carries out a systematic study. Risk identification and cause analysis are carried out, and risk studies are carried out in combination with the case of the rescue of labor workers who encounter Somali pirates. Finally, we consider four aspects: avoiding risk, mitigating risk, transferring risk and accepting risk. The paper puts forward the relevant countermeasures and suggestions to deal with the personal safety risk of foreign labor export personnel. This paper adopts the methods of literature research, classification induction, data analysis, etc. This paper is divided into five parts. The first part is the development and development of china's export of foreign labor services. The second part is the analysis of the personal security risk faced by the foreign labor export personnel of our country. The third part is the analysis of the reasons for the personal safety risk of our foreign labor export personnel. Part 4th is the case of Somali pirates encountered by our crew. Part is to put forward the countermeasures to avoid the risk of personal safety of the foreign labor export personnel of our country. Mitigation of risk, transfer of risk and acceptance of risk, such as the use of government resources, the use of contract terms, Using credit insurance and other scientific countermeasures to help China's foreign labor cooperation enterprises and labor export intermediaries and labor individuals to better deal with personal security risks.
