【摘要】：全球產(chǎn)業(yè)結(jié)構(gòu)正在進(jìn)行調(diào)整,服務(wù)業(yè)轉(zhuǎn)移與服務(wù)外包的浪潮引領(lǐng)了新一輪的國(guó)際產(chǎn)業(yè)轉(zhuǎn)移。從發(fā)展的歷程與趨勢(shì)看,服務(wù)外包這種發(fā)包方將其涉及的服務(wù)業(yè)務(wù)以商業(yè)形式發(fā)包給本企業(yè)以外的接包方的經(jīng)濟(jì)活動(dòng)會(huì)成為全球經(jīng)濟(jì)發(fā)展的重要引擎。服務(wù)外包產(chǎn)業(yè)所具有的調(diào)整經(jīng)濟(jì)結(jié)構(gòu)、快速拉動(dòng)經(jīng)濟(jì)增長(zhǎng)等特點(diǎn),決定了其作為經(jīng)濟(jì)新增長(zhǎng)點(diǎn)的地位。大力發(fā)展服務(wù)外包對(duì)緩解就業(yè)壓力,帶動(dòng)經(jīng)濟(jì)發(fā)展,促進(jìn)人才培養(yǎng),優(yōu)化產(chǎn)業(yè)結(jié)構(gòu)等具有重要意義。 中國(guó)的服務(wù)外包經(jīng)過(guò)最近幾年的快速發(fā)展,取得了不錯(cuò)的成績(jī),但同時(shí)我國(guó)服務(wù)外包領(lǐng)域也出現(xiàn)了一些不容忽視的問(wèn)題。其中,知識(shí)產(chǎn)權(quán)保護(hù)問(wèn)題對(duì)服務(wù)外包的發(fā)展產(chǎn)生了十分重要的影響。本文清晰地界定了服務(wù)外包中的知識(shí)產(chǎn)權(quán),利用新經(jīng)濟(jì)增長(zhǎng)理論、國(guó)際貿(mào)易理論、國(guó)際投資理論、跨國(guó)公司理論分析了服務(wù)外包中涉及的知識(shí)產(chǎn)權(quán)問(wèn)題,盡可能利用相關(guān)理論與實(shí)證結(jié)果,對(duì)服務(wù)外包中的知識(shí)產(chǎn)權(quán)問(wèn)題從理論上進(jìn)行較為系統(tǒng)的梳理。本文對(duì)我國(guó)服務(wù)外包中知識(shí)產(chǎn)權(quán)的現(xiàn)狀進(jìn)行了說(shuō)明,并分析了我國(guó)服務(wù)外包知識(shí)產(chǎn)權(quán)存在的管理問(wèn)題、歸屬問(wèn)題以及商業(yè)秘密及核心技術(shù)泄露問(wèn)題。 中國(guó)與印度在經(jīng)濟(jì)基礎(chǔ)、發(fā)展要求、人口情況等方面都很相似,并在服務(wù)外包方面的共性極大。因此對(duì)中印兩國(guó)在服務(wù)外包的知識(shí)產(chǎn)權(quán)保護(hù)方面的比較很有意義。本文在產(chǎn)權(quán)聯(lián)盟的量化評(píng)定與統(tǒng)計(jì)結(jié)果的基礎(chǔ)上進(jìn)行對(duì)比分析。嘗試從法律狀況、行業(yè)協(xié)會(huì)作用以及保護(hù)意識(shí)的角度,探究差距產(chǎn)生的內(nèi)在原因。希望我們正視差距并從中產(chǎn)生更多的思考,通過(guò)獲得的啟示不斷完善自身對(duì)于服務(wù)外包以及其他方面知識(shí)產(chǎn)權(quán)的保護(hù)。
[Abstract]:The global industrial structure is being adjusted, and the tide of service industry transfer and service outsourcing leads to a new round of international industrial transfer. From the perspective of the development process and trend, the economic activities of service outsourcing, which is contracted out to the contractor outside the enterprise in the form of business, will become an important engine of global economic development. The service outsourcing industry has the characteristics of adjusting the economic structure and pulling the economic growth rapidly, which determines its position as the new economic growth point. It is of great significance to develop service outsourcing to relieve the pressure of employment, to promote economic development, to promote the cultivation of talents and to optimize the industrial structure. After rapid development in recent years, China's service outsourcing has achieved good results, but at the same time, there are some problems that can not be ignored in the field of service outsourcing in China. Among them, intellectual property protection has a very important impact on the development of service outsourcing. This paper clearly defines the intellectual property rights in the service outsourcing, analyzes the intellectual property issues involved in the service outsourcing by using the new economic growth theory, the international trade theory, the international investment theory, and the transnational corporation theory. Using the relevant theory and empirical results as far as possible, the intellectual property rights problem in service outsourcing is systematically combed theoretically. In this paper, the current situation of intellectual property rights in service outsourcing in China is explained, and the problems of management, attribution and leakage of trade secrets and core technologies are analyzed. China and India are very similar in terms of economic base, development requirements, population situation and so on, and have great commonality in service outsourcing. Therefore, China and India in the service outsourcing of intellectual property protection is very meaningful. This paper makes a comparative analysis on the quantitative evaluation and statistical results of the property right alliance. This paper attempts to explore the internal causes of the gap from the perspective of legal status, the role of trade associations and the awareness of protection. Hope that we face the gap and produce more thinking, through the inspiration to constantly improve their own services outsourcing and other aspects of intellectual property protection.
