【摘要】：隨著工業(yè)化推進(jìn)和城鎮(zhèn)化提速,農(nóng)民工正逐步成為產(chǎn)業(yè)工人的主體,也是城市勞動(dòng)力的重要構(gòu)成。從客觀事實(shí)來看,農(nóng)民工大多承擔(dān)苦、累、臟、險(xiǎn)的工作,在經(jīng)歷職業(yè)非農(nóng)化轉(zhuǎn)變的同時(shí)也面臨著角色轉(zhuǎn)型帶來的一系列問題。其中,所從事的高危風(fēng)險(xiǎn)職業(yè)特征決定了他們是工傷事故和職業(yè)病的主要受害者,其職業(yè)安全與健康問題已成為僅次于工資糾紛的第二大突出矛盾。我國(guó)農(nóng)民工工傷保險(xiǎn)制度是農(nóng)民工社會(huì)保障制度體系的重要內(nèi)容。雖然在某些地區(qū)、某些行業(yè)農(nóng)民工工傷保險(xiǎn)制度的構(gòu)建已經(jīng)初見成效,但是在制度的實(shí)際運(yùn)行當(dāng)中,仍然存在著參保率和賠償金額低、農(nóng)民工獲得工傷賠償較難、工傷保險(xiǎn)機(jī)制不完善等問題,這些問題的存在使得農(nóng)民工合法權(quán)益沒有得到切實(shí)維護(hù),嚴(yán)重阻礙了我國(guó)城鎮(zhèn)化的發(fā)展進(jìn)程,不利于解決“三農(nóng)”問題以及和諧社會(huì)的構(gòu)建。因此,深入研究我國(guó)農(nóng)民工工傷保險(xiǎn)問題具有重要的理論價(jià)值和現(xiàn)實(shí)意義。 本文通過對(duì)我國(guó)農(nóng)民工工傷保險(xiǎn)制度存在的問題以及應(yīng)對(duì)策略的論述,探討政府、企業(yè)、農(nóng)民工個(gè)人在工傷保險(xiǎn)中應(yīng)該扮演的角色、應(yīng)該履行的職責(zé),最終達(dá)到促進(jìn)農(nóng)民工工傷保險(xiǎn)制度的健全與完善的效果。文章共分為五部分,第一部分為緒論,介紹了選題背景、研究意義、國(guó)內(nèi)外研究現(xiàn)狀以及研究方法和研究?jī)?nèi)容；第二部分對(duì)相關(guān)概念進(jìn)行了界定,并論述了農(nóng)民工工傷保險(xiǎn)的理論基礎(chǔ)；第三部分對(duì)我國(guó)農(nóng)民工工傷保險(xiǎn)的現(xiàn)狀進(jìn)行了分析,首先介紹了我國(guó)農(nóng)民工工傷保險(xiǎn)從起步到逐漸完善的發(fā)展歷程,隨后介紹了我國(guó)農(nóng)民工工傷保險(xiǎn)實(shí)踐取得的成績(jī),最后指出我國(guó)農(nóng)民工工傷保險(xiǎn)存在的問題；第四部分從政府、企業(yè)和農(nóng)民工三個(gè)主體出發(fā)分析導(dǎo)致我國(guó)農(nóng)民工工傷保險(xiǎn)問題的原因；第五部分針對(duì)存在問題提出相應(yīng)的解決措施。
[Abstract]:With the development of industrialization and the acceleration of urbanization, migrant workers are becoming the main body of industrial workers and the important composition of urban labor force. From the objective facts, migrant workers mostly bear the hardships, tiredness, dirty, dangerous work, in the experience of non-agricultural career transformation, but also face a series of problems brought about by the role transformation. Among them, they are the main victims of industrial accidents and occupational diseases because of their high risk occupational characteristics, and the occupational safety and health problems have become the second most prominent contradiction after wage disputes. The industrial injury insurance system of migrant workers in China is an important part of the social security system of migrant workers. Although the construction of the industrial injury insurance system for migrant workers in some industries has achieved initial results in some areas, in the actual operation of the system, there is still a low rate of insurance participation and compensation, and it is more difficult for migrant workers to obtain compensation for industrial injuries. The existence of these problems makes the legitimate rights and interests of migrant workers not be effectively maintained, seriously hinders the development of urbanization in China, and is not conducive to solving the "three rural" problems and the construction of a harmonious society. Therefore, it is of great theoretical value and practical significance to study the problem of migrant workers' industrial injury insurance in our country. This paper discusses the problems existing in the industrial injury insurance system of migrant workers in China and the countermeasures, and discusses the roles and duties that the government, enterprises and individual migrant workers should play in the process of industrial injury insurance. Finally, to promote the migrant workers injury insurance system sound and perfect effect. The article is divided into five parts, the first part is the introduction, introduced the background of the topic, research significance, domestic and foreign research status, research methods and research content; the second part of the definition of related concepts, The third part analyzes the current situation of migrant workers' industrial injury insurance in our country. Firstly, it introduces the development process of migrant workers' industrial injury insurance from the beginning to the gradual improvement. Then it introduces the achievements in the practice of migrant workers' industrial injury insurance in China, and finally points out the problems existing in the industrial injury insurance of migrant workers in China. Starting from the analysis of the causes of the industrial injury insurance problem of migrant workers in China, the fifth part puts forward the corresponding measures to solve the problems.
