【摘要】：工傷保險(xiǎn)體系是世界上產(chǎn)生最早的社會(huì)保險(xiǎn)。經(jīng)過(guò)100多年的發(fā)展,為達(dá)到新的功能需求,又衍生出了工傷預(yù)防和康復(fù)兩個(gè)相對(duì)獨(dú)立體系,和工傷補(bǔ)償體系共同組成了現(xiàn)代工傷保險(xiǎn)體系。改革開(kāi)放三十年來(lái),東莞市社會(huì)保障體系發(fā)展迅速,于2010年率先于全國(guó)建立起“統(tǒng)一制度、統(tǒng)一標(biāo)準(zhǔn)、統(tǒng)一管理、統(tǒng)一基金調(diào)劑使用”的管理體系,并在相關(guān)政策支持下,構(gòu)建成了工傷預(yù)防、工傷康復(fù)和工傷補(bǔ)償“三位一體”的工傷保險(xiǎn)體系。本文首先通過(guò)對(duì)相關(guān)的文獻(xiàn)進(jìn)行深入研讀,將國(guó)外發(fā)達(dá)國(guó)家的工傷保險(xiǎn)體系總結(jié)成三類,并逐一研究分析,確定國(guó)內(nèi)工傷保險(xiǎn)體系屬于政府全權(quán)參與的管理體系。并界定了構(gòu)建工傷保險(xiǎn)體系的各要素環(huán)節(jié),明確了工傷保險(xiǎn)體系在國(guó)外發(fā)達(dá)國(guó)家的運(yùn)行機(jī)制。其次,將上述的研究成果結(jié)合東莞市的工傷保險(xiǎn)體系的進(jìn)行實(shí)證研究,總結(jié)歸納了東莞市工傷保險(xiǎn)服務(wù)得到眾多好評(píng)的原因,并也發(fā)現(xiàn)體系中存在的問(wèn)題。最后提出相關(guān)的建議與意見(jiàn)。全文以工傷保險(xiǎn)體系的構(gòu)建為主線,重點(diǎn)針對(duì)適應(yīng)東莞發(fā)展的“三位一體”的工傷保險(xiǎn)管理機(jī)制進(jìn)行闡述。筆者對(duì)構(gòu)建東莞市“三位一體”的工傷保險(xiǎn)體系提出具體建議:一是理順工傷保險(xiǎn)體系中各環(huán)節(jié)的關(guān)系,按政府精細(xì)化模塊管理方式進(jìn)行優(yōu)化重組,達(dá)到工傷保險(xiǎn)資源利用最優(yōu)化;二是加強(qiáng)法律、法規(guī)和政策的建設(shè),完善各項(xiàng)執(zhí)行標(biāo)準(zhǔn)的制訂,達(dá)到有法有規(guī)可依的操作要求;三是完善監(jiān)督管理機(jī)制,利用多層面多渠道的監(jiān)督管理手段,達(dá)到保證工傷保險(xiǎn)基金運(yùn)營(yíng)的安全。特別是在工傷醫(yī)療與工傷康復(fù)方向的管理建議,是筆者創(chuàng)新的理念,請(qǐng)各位專家不吝指正
[Abstract]:Industrial injury insurance system is the earliest social insurance in the world. After more than 100 years of development, in order to meet the new functional requirements, two relatively independent systems of industrial injury prevention and rehabilitation have been derived, and a modern industrial injury insurance system has been formed together with the industrial injury compensation system. In the past 30 years of reform and opening up, the social security system of Dongguan City has developed rapidly. In 2010, it took the lead in establishing a management system of "unified system, unified standards, unified management, unified fund allocation and use" in the whole country, and supported by relevant policies. Construction of industrial injury prevention, industrial injury recovery and compensation of the "trinity" of industrial injury insurance system. In this paper, through the in-depth study of the relevant literature, the industrial injury insurance system in developed countries is divided into three categories, and one by one research and analysis, determine that the domestic industrial injury insurance system belongs to the management system with the full participation of the government. It also defines the key elements of the construction of industrial injury insurance system, and clarifies the operating mechanism of industrial injury insurance system in developed countries. Secondly, combining the above research results with the empirical study of the industrial injury insurance system in Dongguan City, summed up the reasons why the industrial injury insurance service in Dongguan City has been received a lot of praise, and also found the existing problems in the system. Finally, some suggestions and suggestions are put forward. This paper takes the construction of industrial injury insurance system as the main line, focusing on the "trinity" management mechanism of industrial injury insurance which adapts to the development of Dongguan. The author puts forward some concrete suggestions to construct the "trinity" industrial injury insurance system in Dongguan City: first, to straighten out the relationship between the various links in the industrial injury insurance system, and optimize and reorganize the industrial injury insurance system according to the government's meticulous modular management mode. To optimize the utilization of industrial injury insurance resources; second, to strengthen the construction of laws, regulations and policies, and to improve the formulation of various executive standards to meet the operational requirements of having laws and regulations to abide by; and third, to improve the supervision and management mechanism, To ensure the safety of industrial injury insurance fund operation by means of multi-level and multi-channel supervision and management. In particular, the management suggestions on the direction of medical treatment and rehabilitation of work-related injuries are the innovative ideas of the author.
