【摘要】：近年來，學(xué)校意外傷害事故時有發(fā)生，不僅影響學(xué)校正常的教育教學(xué)秩序，也使學(xué)校面臨各類法律糾紛，甚至影響社會局部穩(wěn)定。為進一步加強學(xué)校風(fēng)險管理工作，維護學(xué)校正常教育教學(xué)秩序，促進平安和諧校園建設(shè)，2008年教育部、財政部、中國保險監(jiān)督管理委員會聯(lián)合下發(fā)《關(guān)于推行校方責(zé)任保險完善校園意外傷害事故風(fēng)險管理機制的通知》，通知在原有的管理手段和方法基礎(chǔ)上提出建立和完善校方責(zé)任保險制度，把學(xué)校的賠付責(zé)任轉(zhuǎn)嫁給保險公司，實現(xiàn)學(xué)校、受害家庭、保險公司三方的共贏。同時，隨著校方責(zé)任保險的逐步實施和完善，作為學(xué)校進行風(fēng)險管理和控制的基本手段，校方責(zé)任保險制度在有效防范和妥善化解各類安全事故風(fēng)險、強化教育教學(xué)安全管理工作、建立和完善教育風(fēng)險轉(zhuǎn)移機制、不斷提高構(gòu)建平安和諧校園的能力等方面發(fā)揮了重要作用。 甘肅省2008年在政府主導(dǎo)下建立了中小學(xué)校方責(zé)任保險制度，實施六年來，其運作機制如何？實施效果怎樣？是否真正做到了學(xué)校、受害家庭與保險公司三方共贏？為此，在對甘肅省教育行業(yè)管理部門、保監(jiān)局及相關(guān)保險機構(gòu)、學(xué)校實地調(diào)研的基礎(chǔ)上，本文全面梳理了甘肅省校方責(zé)任保險實施的具體情況�？傮w看，在政府主導(dǎo)及大力推動下，堅持市場運行模式，校方責(zé)任保險迅速在全省中小學(xué)范圍內(nèi)得以實施。近年來校方責(zé)任保險業(yè)務(wù)發(fā)展相對穩(wěn)定，在保障學(xué)生合法權(quán)益、維護學(xué)校安全穩(wěn)定及正常的教育教學(xué)秩序、構(gòu)建和諧校園及和諧社會方面發(fā)揮了不可替代的作用，其校園風(fēng)險保障及社會管理功能日益顯現(xiàn)。 責(zé)任保險在我國尚處于起步階段，校方責(zé)任保險更是剛剛起步，實施過程中必然存在著覆蓋面較窄、社會認(rèn)知度較低、保費籌措渠道單一等困難和問題，這在經(jīng)濟發(fā)展相對落后、教育經(jīng)費緊張的甘肅省表現(xiàn)的更是突出。結(jié)合甘肅省實際情況，，并借鑒國內(nèi)外有關(guān)校方責(zé)任保險的發(fā)展經(jīng)驗，本文認(rèn)為應(yīng)進一步界定校方責(zé)任保險的性質(zhì)及社會價值，在政府主導(dǎo)、市場運作的原則下，需繼續(xù)加大政府推動力度，擴大其覆蓋面。同時，進一步調(diào)動保險公司參與校方責(zé)任保險的積極性，特別是進行產(chǎn)品創(chuàng)新及提高保險服務(wù)水平。另外，只有這樣，才能創(chuàng)造良好的發(fā)展環(huán)境，切實加快甘肅省校方責(zé)任保險的發(fā)展。
[Abstract]:In recent years, school accidents occur from time to time, which not only affect the normal order of education and teaching in schools, but also make schools face various legal disputes, and even affect the local stability of society. In order to further strengthen school risk management, maintain normal school education and teaching order, and promote the construction of a peaceful and harmonious campus, the Ministry of Education, Ministry of Finance, Notice issued jointly by the China Insurance Regulatory Commission on the implementation of school liability insurance to improve the risk management mechanism of campus accidents and injuries, the notice proposing the establishment and improvement of the school on the basis of the original management means and methods Party liability insurance system, Transfer the liability of the school to the insurance company and realize the win-win situation of the school, the victim family and the insurance company. At the same time, with the gradual implementation and improvement of school liability insurance, as a basic means of risk management and control, the school liability insurance system is effectively preventing and properly resolving all kinds of risk of safety accidents. It has played an important role in strengthening the safety management of education and teaching, establishing and perfecting the transfer mechanism of educational risks, and improving the ability of constructing a safe and harmonious campus. Gansu Province in 2008 under the leadership of the establishment of primary and secondary school liability insurance system, the implementation of six years, its operating mechanism? How did it work? Is it true that schools, families and insurance companies all win together? Therefore, on the basis of the field investigation of Gansu Province education industry management department, insurance bureau and related insurance institutions, this paper comprehensively combs the concrete situation of Gansu Province school responsibility insurance implementation. Overall, under the government leading and vigorously promoting, adhere to the market operation mode, school liability insurance is quickly implemented in the province's primary and secondary schools. In recent years, the development of school liability insurance has been relatively stable, which has played an irreplaceable role in safeguarding the legitimate rights and interests of students, maintaining the safety, stability and normal educational and teaching order of the school, and building a harmonious campus and a harmonious society. Its campus risk protection and social management functions are increasingly apparent. The liability insurance is still in the initial stage in our country, and the school liability insurance is just beginning. In the process of implementation, there must be some difficulties and problems, such as narrow coverage, low social cognition, single channel for raising insurance premium, etc. This is relatively backward in economic development, education funds are tight in Gansu Province performance is more prominent. Combined with the actual situation of Gansu Province, and drawing lessons from the development experience of school liability insurance at home and abroad, this paper holds that the nature and social value of school liability insurance should be further defined, under the principle of government leading and market operation. Need to continue to increase government efforts to expand its coverage. At the same time, we should further mobilize the enthusiasm of insurance companies to participate in school liability insurance, especially for product innovation and improvement of insurance service level. In addition, only in this way can we create a good development environment and speed up the development of Gansu Province's school liability insurance.
