【摘要】：近來(lái),學(xué)生傷害事故的發(fā)生和處理頻繁見報(bào),成為了社會(huì)關(guān)注的熱點(diǎn)問題。又有研究表明體育課上發(fā)生的事故占據(jù)了整個(gè)學(xué)校學(xué)生傷害事故的主要部分,而且所占的比例有逐年遞增的趨勢(shì),但就我國(guó)已頒布的法律來(lái)說(shuō),對(duì)此類事故中各方責(zé)任的認(rèn)定尚不明確,對(duì)事故的處理亦缺乏具體的規(guī)定,導(dǎo)致在此類事故中法律的可操作性不強(qiáng),爭(zhēng)議也頗多,這些都不利于學(xué)校體育的健康發(fā)展。這種狀況的出現(xiàn)主要是由于我國(guó)有關(guān)學(xué)校體育傷害事故的立法研究起步較晚、立法意識(shí)較為薄弱造成的,它還直接的影響到事故處理的公平性和合法性。在司法實(shí)踐中學(xué)校傷害事故的處理需要成熟的法律作為導(dǎo)向,所以需要我國(guó)學(xué)校體育傷害事故的立法進(jìn)一步系統(tǒng)和完善,因此,對(duì)于學(xué)校體育傷害事故中的焦點(diǎn)問題進(jìn)行探討、研究,即有利于保護(hù)事故中當(dāng)事人即學(xué)校、教師、家長(zhǎng)、學(xué)生的合法權(quán)益,更有利于學(xué)校體育的蓬勃發(fā)展。本文運(yùn)用案例分析、邏輯推理分析、專家訪談和文獻(xiàn)資料等方法,首先簡(jiǎn)述了體育教學(xué)、學(xué)校體育傷害事故的概念,繼而分析了對(duì)體育傷害事故研究的兩性,同時(shí)又簡(jiǎn)單的敘述了高校體育教學(xué)中學(xué)生傷害事故產(chǎn)生的原因及特點(diǎn)和事故處理的法律依據(jù)及范圍,進(jìn)而在基本理論已然明晰的基礎(chǔ)上對(duì)學(xué)校法律上的地位、權(quán)利和義務(wù)、學(xué)校在事故中需盡的注意義務(wù)和其與學(xué)生之間的關(guān)系進(jìn)行了刨析,最后在洞悉了基本理論和基本關(guān)系的前提下對(duì)事故中責(zé)任的分類以及歸責(zé)原則的適用做了一定的分析。希望能以此為我國(guó)在體育事故中立法的理論探索奉獻(xiàn)微薄之力。
[Abstract]:Recently, the frequent occurrence and treatment of student injury accidents has become a hot issue of social concern. Some studies show that accidents in physical education class occupy the main part of the whole school students injury accidents. And the proportion of the increasing trend year by year, but the law has been promulgated in our country, the identification of the responsibility of the parties in such accidents is not clear, the handling of the accident is also lack of specific provisions. As a result of this kind of accidents, the operability of the law is not strong, and there are many disputes. These are not conducive to the healthy development of school sports. This situation is mainly due to the late start of legislation on school sports injury accidents, legislative awareness is relatively weak. It also directly affects the fairness and legality of accident handling. In judicial practice, the treatment of school injury accident needs mature law as the guidance. Therefore, it is necessary to improve the legislation of school sports injury accident in our country. Therefore, the focus of the school sports injury accident is discussed and studied, that is to say, it is beneficial to protect the parties in the accident, that is, the school. The legitimate rights and interests of teachers, parents and students are more conducive to the vigorous development of school physical education. This paper uses the methods of case analysis, logical reasoning analysis, expert interviews and literature, etc. The concept of school sports injury accident, and then analyzed the gender of sports injury accident research. At the same time, it simply describes the causes and characteristics of the injury accidents of the students in physical education teaching in colleges and universities, and the legal basis and scope of dealing with the accidents, and then, on the basis of the clear basic theory, the legal status of the school. The rights and obligations, the school's duty of care in the accident and the relationship between the school and the students were analyzed. Finally, on the premise of understanding the basic theory and the basic relationship, the author makes a certain analysis on the classification of responsibility in accidents and the application of the principle of imputation. It is hoped that this will contribute to the theoretical exploration of legislation in sports accidents in our country. Power.
