【摘要】：大學(xué)招生制度為高校選拔人才提供了重要保證,它的制定和運(yùn)行都受到憲法的影響和約束,對(duì)大學(xué)招生制度合憲性的分析可以從法理的角度審視這一社會(huì)制度在保障公民權(quán)利中的作用。以教育公平與憲法精神的關(guān)系為切入點(diǎn),分析大學(xué)教育公平和憲法精神的關(guān)系,探討憲法政治和法律屬性對(duì)促進(jìn)教育公平的作用,分析現(xiàn)行大學(xué)招生制度中部分不合憲性的表現(xiàn),對(duì)大學(xué)招生制度向憲法屬性和憲法精神發(fā)展的趨勢(shì)做出預(yù)判。
[Abstract]:The university enrollment system provides an important guarantee for the selection of talents in colleges and universities, and its formulation and operation are influenced and restricted by the Constitution. The analysis of the constitutionality of university enrollment system can examine the function of this social system in the protection of civil rights from the angle of legal theory. Based on the relationship between education equity and constitutional spirit, this paper analyzes the relationship between university education equity and constitutional spirit, and probes into the role of constitutional political and legal attributes in promoting education equity. Based on the analysis of the unconstitutionality of the current university enrollment system, this paper prejudges the tendency of the university enrollment system to the development of the constitutional attribute and the constitutional spirit.
