【摘要】：自治性是英國大學(xué)這一組織天生的社會屬性,自其誕生之日起,就是一個由學(xué)者們以實現(xiàn)學(xué)術(shù)切磋、科學(xué)探索和知識傳授為目的,具有自發(fā)性和獨立性的社會團(tuán)體。同其他國家相比,英國大學(xué)既不是獨立于國家的私立機構(gòu),也不是國家所有或國家控制的組織,大學(xué)的組織框架和決策程序是以學(xué)者治校和民主管理為基礎(chǔ)的。在此前提下,英國大學(xué)章程的存在就顯得尤為重要。 法律是一種帶有強制性色彩的規(guī)范條例,英國大學(xué)章程作為有效的校內(nèi)法,其最顯著的作用就是大學(xué)發(fā)展過程中維系保障大學(xué)的穩(wěn)定秩序。章程自制定起就具有被承認(rèn)的合法效力,校內(nèi)最高領(lǐng)導(dǎo)機構(gòu)擁有章程的制定及修改權(quán),章程明確規(guī)定了校內(nèi)各權(quán)利主體的權(quán)責(zé)劃分,保障大學(xué)作為學(xué)術(shù)科研中心的地位并且對章程的修改及處理校內(nèi)各種特殊問題有嚴(yán)格明確的規(guī)定。通過分析大學(xué)章程在英國大學(xué)自治中所起的作用,結(jié)合我國切實國情取其助益因素,以期幫助我國現(xiàn)階段的大學(xué)章程建設(shè)。 文章分為六個部分,第一部分是緒論部分,主要介紹研究的背景、意義,對當(dāng)前的研究狀況進(jìn)行綜述,并對涉及的重要概念進(jìn)行界定,討論了大學(xué)治理與大學(xué)章程二者之間的關(guān)系。第二部分將搜集到的文獻(xiàn)資料進(jìn)行梳理,介紹了英國大學(xué)章程在各個階段的歷史沿革,并分析了引起大學(xué)章程變化的原因。第三部分通過對牛津大學(xué)、劍橋大學(xué)及倫敦大學(xué)的章程進(jìn)行文本分析,總結(jié)了英國大學(xué)章程涵蓋的基本內(nèi)容以及章程的文本特點。第四部分著重描寫的是英國大學(xué)章程的實效性,以及章程實施中的實效保障。第五部分是在前文的基礎(chǔ)上得到的一些啟示,提出健全我國大學(xué)章程在制定時需要明白大學(xué)章程的價值取向,提高對大學(xué)章程的認(rèn)識程度；大學(xué)章程在制定中的相關(guān)重點問題,明確大學(xué)章程的法律地位；以及大學(xué)章程所涉及的部分現(xiàn)實問題。第六部分是結(jié)語,對本研究的結(jié)論與不足,及論文的進(jìn)一步完善進(jìn)行表述。
[Abstract]:Autonomy is a natural social attribute of the British university. Since its birth, it has been a voluntary and independent social organization with the aim of realizing academic exchanges, scientific exploration and knowledge teaching.Compared with other countries, British universities are neither independent of the private institutions of the state, nor are they owned or controlled by the state. The organizational framework and decision-making process of the universities are based on academic administration and democratic management.Under this premise, the existence of British university charter is particularly important.Law is a kind of standard regulation with mandatory color. As an effective internal law, the most prominent function of British university charter is to maintain the university's stability and order in the process of university development.The articles of association have the legal effect of being recognized since they were made, and the supreme leading organ of the school has the power to make and amend the articles of association. The articles of association clearly stipulate the division of the powers and responsibilities of the subjects of rights and responsibilities in the school.To ensure the status of the university as an academic and scientific research center, and to amend the constitution and deal with all kinds of special problems in the university.By analyzing the role of university charter in British university autonomy and combining with the actual situation of our country, this paper tries to help the construction of university charter in our country at the present stage.The article is divided into six parts, the first part is the introduction part, mainly introduces the research background, the significance, carries on the summary to the present research situation, and carries on the definition to the important concept involved,The relationship between university governance and university charter is discussed.The second part combs the collected literature, introduces the history of the British university charter in each stage, and analyzes the reasons for the change of the university charter.The third part summarizes the basic contents and characteristics of the statutes of the British universities through the text analysis of the statutes of Oxford University, Cambridge University and the University of London.The fourth part focuses on the effectiveness of the constitution of the British university and the actual effect guarantee in the implementation of the charter.The fifth part is some enlightenments on the basis of the above, and points out that in order to perfect the university charter in our country, we should understand the value orientation of the university charter, improve our understanding of the university charter, and put forward some key issues in the process of the university charter formulation.Clarify the legal status of the university charter and some practical problems involved in the university charter.The sixth part is the conclusion, the conclusion of this study, and the further improvement of the paper.
