【摘要】：政府規(guī)制是政府的一種治理工具,以彌補市場缺陷、矯正市場失靈為目的。政府對民辦學校進行規(guī)制的基本目標就是要確保其公益性的發(fā)揮和實現(xiàn)。政府在行政管理過程中對民辦學校的監(jiān)管失靈主要表現(xiàn)在:功利主義的管理理念、控制主義的管理目的、行政主義的管理方式和形式主義的管理手段。政府應將自身置于社會之中去進行規(guī)制,實現(xiàn)規(guī)制與被規(guī)制的互動,在信息交流和互動中提升對民辦學校的管理水平和規(guī)制質量,從而使規(guī)制成為引導民辦學校發(fā)展,而不僅僅是控制的治理工具。政府對民辦學校的規(guī)制也應當依法進行,以尋求政府規(guī)制的法治化,為我國民辦學校的自主發(fā)展提供穩(wěn)定、持續(xù)的法治支持。
[Abstract]:Government regulation is a kind of governance tool of the government to make up for the defects of the market. The basic goal of the government to regulate the private schools is to ensure the public welfare of them. In the process of administration, the failure of government supervision over the private schools is mainly manifested in: utilitarian. The management philosophy of the. Government should put itself in the society to regulate, to realize the interaction between regulation and regulation, the management purpose of control doctrine, the management method of administration doctrine and the management means of formalism, the government should put itself in the society to regulate, and realize the interaction between regulation and regulation. In the process of information exchange and interaction, the management level and regulation quality of private schools should be improved, so as to make regulation become a governance tool to guide the development of private schools, not just control. In order to seek the rule of law of government regulation, to provide stable and sustained legal support for the independent development of private schools in China.
