【摘要】：20世紀(jì)90年代以來(lái),受?chē)?guó)家邏輯(包括立法規(guī)制、司法審查與行政監(jiān)督)、大學(xué)邏輯、學(xué)生個(gè)體邏輯以及民間社會(huì)邏輯等多重制度邏輯的深刻影響,中國(guó)公立高校學(xué)生管理規(guī)則系統(tǒng)呈現(xiàn)出從“管理法”向“平衡法”的演進(jìn)軌跡�！镀胀ǜ叩葘W(xué)校學(xué)生管理規(guī)定》自1990年以來(lái)的兩次修訂以及各公立高校學(xué)生管理規(guī)則的演進(jìn)表明,大學(xué)自治正在接受法治拷問(wèn)。正當(dāng)程序原則、比例原則、法律保留原則、信息公開(kāi)原則等行政法治的基本原則開(kāi)始逐漸被特殊“適用”,學(xué)術(shù)自治與權(quán)益保護(hù)的平衡成為規(guī)則演進(jìn)的價(jià)值旨?xì)w。傳統(tǒng)的受教育權(quán)范式正在被倡導(dǎo)學(xué)習(xí)自由的學(xué)習(xí)權(quán)所取代,將學(xué)習(xí)的權(quán)利還給學(xué)生成為趨勢(shì)。作為特殊行政主體或特別公法人的公立高校,其法治秩序的建構(gòu)日益重視回應(yīng)高教法治與行政法治的演進(jìn)趨勢(shì)并嵌入與吸納其有益要素。中國(guó)公立高校學(xué)生管理規(guī)則系統(tǒng)應(yīng)更加重視法治思維與精神的凝練,彰顯“平衡法”的基本理念與實(shí)踐模式。“平衡法”的興起亟待重構(gòu)多重制度邏輯,尋求國(guó)家監(jiān)督、大學(xué)自治與學(xué)生權(quán)益保護(hù)等多重沖突利益之間的平衡。通過(guò)“國(guó)家法”與“大學(xué)法”、“硬法”與“軟法”的良性互動(dòng),促進(jìn)大學(xué)哲學(xué)內(nèi)涵的法律化。
[Abstract]:Since the 1990s, it has been deeply influenced by the multi-system logic, such as national logic (including legislative regulation, judicial review and administrative supervision), university logic, student individual logic and civil society logic. The system of student management rules in Chinese public colleges and universities shows the evolution from "management law" to "balance law". The "regulations on Student Management in ordinary institutions of higher Learning" has been revised twice since 1990 and the evolution of student management rules in various public colleges and universities. University autonomy is being grilled by the rule of law. The basic principles of administrative rule of law, such as the principle of due process, the principle of proportionality, the principle of legal reservation, the principle of information disclosure, etc., have been gradually applied to the special "application", and the balance between academic autonomy and protection of rights and interests has become the value purport of the evolution of the rules. The traditional paradigm of the right to education is being replaced by the right to learn freely, and it is a trend to return the right to study to students. As a special administrative subject or special public legal person, public universities pay more and more attention to respond to the evolution trend of higher education rule of law and administrative rule of law, and embed and absorb its beneficial elements. The system of students' management rules in Chinese public colleges and universities should pay more attention to the condensed thinking and spirit of rule by law, and show the basic idea and practice mode of "balance method". The rise of "balance law" needs to reconstruct the logic of multiple systems and seek a balance between the interests of multiple conflicts such as state supervision, university autonomy and the protection of students' rights and interests. Through the positive interaction between "the State Law" and "the University Law", "hard Law" and "soft Law", the legalization of the connotation of university philosophy is promoted.
