【摘要】：公辦高校既為法人,其法人意思的形成和實現(xiàn)均有賴于學(xué)校內(nèi)部機關(guān),其中學(xué)校黨委作為執(zhí)政黨基層組織,統(tǒng)一領(lǐng)導(dǎo)學(xué)校工作,對學(xué)校重大事項行使決策權(quán),形成法人意思,構(gòu)成公辦高校法人治理結(jié)構(gòu)中的決策機構(gòu),具有堅實的法理基礎(chǔ),是公辦高校領(lǐng)導(dǎo)體制長期反復(fù)探索實踐的改革經(jīng)驗結(jié)晶,并已為法律最終確認。探索完善基于"黨委領(lǐng)導(dǎo)下的校長負責制"的公辦高校法人治理結(jié)構(gòu),首要的是明確公辦高校黨委的法人決策機構(gòu)地位,學(xué)校其它機構(gòu)如校務(wù)委員會、董事會、教職工代表大會等均不成其為決策機構(gòu),同時應(yīng)厘清黨委決策與校長負責制、黨委書記職責及學(xué)術(shù)組織職權(quán)的關(guān)系等關(guān)鍵問題。
[Abstract]:The formation and realization of the intention of legal person depends on the internal organs of the school, in which the party committee of the school, as the basic organization of the ruling party, unifies the work of the school and exercises the decision-making power on the important matters of the school. Forming the meaning of legal person and forming the decision-making organization in the corporate governance structure of public colleges and universities has a solid legal basis and is the crystallization of the reform experience of the leadership system of public colleges and universities which has been exploring and practicing for a long time. And finally confirmed for the law. To explore and improve the corporate governance structure of public colleges and universities based on the "president responsibility system under the leadership of the party committee", the most important thing is to make clear the status of the legal person decision-making organization of the public university party committee. Other school organizations such as the school affairs committee, the board of directors, the faculty Congress and so on are not the decision-making organs, at the same time should clarify the party committee decision-making and the principal responsibility system. Party committee secretary duty and academic organization authority relation and so on key question.
