【摘要】：高等教育評估權(quán)是典型的行政權(quán)力,專業(yè)評估機(jī)構(gòu)取得的高等教育評估權(quán)不是法律意義上的行政授權(quán)而是行政委托。根據(jù)評估結(jié)果對被評估院校的影響程度,高等教育評估主要分為合格評估和質(zhì)量評估兩類,其中,合格評估大多為行政確認(rèn)行為,質(zhì)量評估大多為行政指導(dǎo)行為。高等教育評估權(quán)行使過程,時(shí)刻縈繞著政府評估權(quán)與學(xué)校辦學(xué)自主權(quán)、學(xué)科專業(yè)評估權(quán)與學(xué)術(shù)自由權(quán)、政府舉辦權(quán)與大學(xué)自治權(quán)、依法監(jiān)督權(quán)與公益保障權(quán)的糾葛和沖突。重新審視高等教育評估權(quán)的要素法定性、價(jià)值社會性、權(quán)益準(zhǔn)公共性、主體多元性、功能開放性、法律地位中介性等基本特征,將極大緩解上述矛盾,使高等教育評估真正發(fā)揮促建、促改、促管的正能量。
[Abstract]:The right of higher education evaluation is a typical administrative power. The right of higher education evaluation obtained by professional evaluation institutions is not an administrative authorization in the sense of law but an administrative entrustment. The evaluation of higher education is mainly divided into two categories: qualified assessment and quality assessment, among which, the qualification assessment is mostly administrative confirmation behavior, and the quality assessment is mostly administrative guidance behavior, and the process of exercising the right of higher education evaluation. The right of government evaluation and the autonomy of school running, the right of subject and specialty evaluation and the right of academic freedom, the right of government organization and the right of university autonomy haunt all the time. The conflict between the right of supervision according to law and the right of public welfare. Reexamine the legal nature of the elements of the right of evaluation of higher education, the value sociality, the quasi-public nature of the rights and interests, the pluralism of the subject and the openness of the function. The basic characteristics of intermediary legal status will greatly alleviate the above contradiction and make the evaluation of higher education bring into full play the positive energy of promoting construction, reform and management.
